Beware young traveller, the roads of doom! I know the road - not a long ride, not a road well away from home, but a local street. I have made mention of the state of this street to the council previously (phoned them) and again through the councillor that lives across the road after yesterday.
I went to go to the shop. I know the seal has a dip on that corner so I slowed accordingly to retain some stability. The front wheel decided today was not a good day to remain heading straight and true and tucked in. We went down. Busted indicator, headlight fairing, and foot brake lever. Various scratches too!
I'm annoyed more than anything - I pay rates. I should have the right to have safe rideable roads - especially local streets. Now it'll cost me another couple of hundred to get my bike fixed - AGAIN.
IT'LL COST ME - NOT THE F*CKING COUNCIL! If you are a Wellington based biker and see or ride shitty roads - make some noise about it. If it is not fixed in a week ring again and keep ringing or making noise til it gets fixed - You could be paying for repairs you shouldn't have to make. This was not rider error (Ihave no problem accepting if I f*ck up) this is poor road maintenance.
Incidentally, I am bruised but ok.

But yes all riders should ring in when they do not fix the roads. I hate when they do fix them and not put any signs up!! Got caught out a few times now!!!

Keep up the good work of leading the crusade of BAPH :eek: (Bikers Against Pot Holes) It doesnt take much, especially when you are just leaving home and tyres are cold, rider not warmed up etc. There's a gouge in the road at our roundabout 1km away as you turn left heading downhill towards the toll road. Im so conscious the bloody thing is there, and make a point of avoiding it every time I go that way

We were out in the car yesterday and drove through two huge patches of stones around West Harbour (auckland), came out the end and heard a nasty scraping from one of the wheels... almost took it into a garage to get it looked at, but seemed a stone had got lodged in the brakes or something... bloody council don't care though, they're not legally responsible.

Bummer ... sometimes the worst outcome is damage to the much-loved bike. I want to scream at people who say "yeah but you're ok - that's all that matters". Mostly I'm much more ferked orf about the bike ... so I feel for ya.
Come to the MotoGP session at Kitty's this afternoon and blow some steam off with us. I'll buy you a sympathy one

Speaking of potholes... How's this, after hitting one on the Tauraunga side of the Kaimais. Doing about 80k's - pissing rain, caught up to a couple of cages, about to turn off in < 100metres, and CRASH! Poor bike leapt in the air, bounced around a bit - but stayed upright...
Of course the District council denied all responsibility for any damage... I ended up buying a new rim in the end - may get the damaged one straightened sometime... Pics show damage AFTER I'd taken to the dent with a lump of wood, and a HEAVY hammer to try and flatten it in so I could get home...

Latest BRM mag ( I think) there was a letter to the editor from someone whose cousin had taken Transit to small claims court for damage done to Harley due to road condition (no chip left in seal) and they WON! Seem the council knew about it, did nothing till a few accidents occurred then fixed it quickly - tried to cover it up. But the cunning bikers managed to get a piece of the old road and took that along to court, as well as cops statement about state of road at the time.

Several people have gone the councils who are aware of damage to roads and not done anything about it and WON.
Take photos of the road before they fix it and get statements from people who know of the damage.
Give it a go, you may have a good case.
BRONZ are looking for ammunition for this sort of thing, at lease in Auckland anyway.

thats exactly what you should do, take photos, get the councillor down there to, take em to small claims and with the photos and the councilllor sayin he has told the council you may just win, may cost you $30 but what is that in the grand scheme of things if you already have to repair the bike, steveb64 should have done the same

Sorry to here about this Col, If you realy badly damaged yourself ACC might have done something about it they love to sue the other person especialy if you are a boss. Police are always promoting safe driving but for us bikers it seems to be the badly maintained roads that bring us to grieff. One my grandkids came off their push bike on loose gravell, council came and swept it up but no compo for the kids bike.:argh:

Is the bike ridable/legal? If not - what's it need?
Edit - not sure if these help, but from a previous thread on a similar subject... wel... the same subject from what I can see.
Find out who the contractor was, ask if the cleanup was part of the contract and have them clarify why it was not done. Write to contractor, register the costs with them and when they say "naff off" contact Disuptes Tribunla (or whatever the hell it's called these days).
As per Jills Pea-ing problem - there is a precedent that awarded damages to a motorcyclist felled by unsignposted roadworks.

There are three aspects to this, which should apply to roads irrespective of the road controlling authority; i.e. whether the road is State Highways or a local one looked after by council. The primary issue is that of safety in that loose material does not get onto a road so that markings are obscured, or that materials do not effect vehicles traveling over them.
The first of these aspects is to have measures in place to either lower speed where loose materials might be encountered or give some pre-warning. Such an example is that of a chip sealed road, which at the end of 48 hours after sealing, is swept and pavement marked, then the temporary speed restriction removed. This sort of requirement is usually written into the contract under which the work is being carried out.
If there is construction works then the contract conditions usually requires that no materials are spread off site.
Thirdly if materials are inadvertently dropped from a passing vehicle, then they need to be removed in a timely manner. In some instances this will require emergency action and cleaned up as soon as practical or if within the maintenance contract response times, if there is no imminent danger to passing traffic. If a truck operator spills materials onto the road then they can be prosecuted for an insecure load as well as been held liable for third party damage.
I hope this covers you concern. However, if you are aware of any location on SH's where you believe there is loose metal, please keep us informed. We will have the location inspected and the situation rectified.

What is the best course of action in those situations where a contractor fails to adequately sweep the surface resulting in vehicle damage? My concern stems from a number of incidents (and a good number of "near misses") in the motorcycling community where our safety is compromised by the presence of a relatively small amount of loose chip.
I realise it's impractical to always get 100% of loose material of the road, and freely concede the burden of safety is shared by the motorist needing to drive (or ride) to the conditions. A particularly concerning situation that affects bikes is loose chip present on the apex of a corner - out of sight on approach, greatly reducing traction while leaning through the corner, reducing braking, and reducing manoeuvring capability.
In a situation of unmarked chip, or other residual debris causing a loss of control resulting in loss of control and accident, is Transit or the contractor ultimately responsible for costs incurred?

thats real shitty Col, up north theres from Kawakawa to Kaitaia there are some REALLY shitty roads...Especially after all the flooding,some roads still messed up....Pity bout your bike

As said, I am lucky. I coulda falleded in front of a bus! BUT I didn't, all I got was a booboo and a semi busted bike... One day it'll be all nice and shiny and new looking again.. then I'll put it in a glass box and only polish it sometimes...

Since the little falleded I have seen action aplenty happen on the stretch of road mentioned. The work has been completed and there is a brand new section (including flash kerbing) of beautifully sealed footpath now! I can't wait to ride my bike along there to see just how much it's improved...
