Hi guys,I had kids bike on trademe for a while but never sold, i got a request to drop the price by $100.00 then they would buy it, so i did, withdrew it from trademe at the request of the buyer.1 week later on a friday they picked it up, get a call from these people on saturday to say the bike is not fast enough, i said he can have his money back end of story every body happy, then he is now saying that there is no spark cant get it going. This guy took the bike going and wants to bring it back not going and wants his money back, Yeah right. What do you guys think Thanks Paul

That really sucks paul. I would want to see the bike and see if you can figure out what the problem is with it. But really, if you started it when he came to get it, and he had the time to have a look at it first then its not your problem. You did not sell the bike with a granuntee, ure not a shop. If you sold it in good faith then you have nothing to wworry about.
Good luck

The first thing he said is that it wasnt fast enough this is what his 8 year old son said to him, then the next call i got from him is he said that there is no spark. He welded the muffler while it was on the bike did not disconnect any wiring or anything so i think he has sent some kind of pulse through the bike and cooked it,would that sound right he used a mig welder.

Yeah the welding would have cooked the wiring!

Tell him to get fucked if he's been fiddling around with it. Hell, if it was altered in any way -- if he'd changed even the mirrors -- I wouldn't be taking it back at all, let alone if there's a chance he's cooked the wiring. No way, man.

Keep the $$'s and walk away. As you withdrew the auction he can not even red rep you.
He has the bike. He has a problem that was not there when he bought it.
And a 8yo telling dad the bike is not fast enuf???

His bike his problem. A can of worms if you start getting involved.
By the sounds of it he has been mucking (with an f) around with it and doesnt want to let dad know its now toast.

You were nice to start with offering to refund the money. If they were saying it wasn't fast enough they probably have been thrashing it.
But from the sounds of it - there is a good chance that the wiring has been cooked (or more likely the ECU fried if there is one).
I would just tell them that you are unwilling to refund as they are not returning the bike as they sold it to you.
Then simply refuse to get into discussions with them. Their bike, their problem, your cash - tell them you have spent it all on hookers and drugs and dont have any left anyway.

What they said. ^
You were more than reasnable to start with, now they are trying to do you over.
Take youre money, ignore any emails and don't answer their phone calls.
And dont feel bad about it for a second.

I agree with the rest......keep the money and tell him to piss off
would be different story if the bike was being return in the same working condition as you sold it anything less is unacceptable

The buyer is lacking in the scruples department, I'd bet dollars for donuts that he's swapped the good bits off your old bike onto his other one.
Tell him to bugger off, the bike is no longer in the condition that it was at time of sale.

Tell them to get stuffed. If they bought the bike and found that it wasn't fast enough for their purpose, that's not your problem at all!
Deal done is a done deal!
Unless of course you gave them any guarantee that the bike would be fast enough and that you'd refund the purchase if they found it so.

walk away. make sure you make note of all convos etc just in case he decides to try small claims or something.

just in case he decides to try small claims or something.
Even if they decide to go that way, he still tampered with the bike so it cant come back in it original condition.

+1 on that advice. Hang tough. By agreeing to refund you have shown yourself to be a reasonable person, "they" on the other hand are shysters. Good luck anyway.:rockon:

no question as to what you should do-- tell them to get phucked ( maybe not in those words!). youve done absolutley nothing wrong, sold the bike in working condition and sounds like you were very reasonable when they first approached you. hes been pissing round with it and it stops going? not your problem!!
and also if he has another one of the same bike that makes the "too slow" claim also seem very unlikely as they would know exactly what said bike goes like! man some people piss me off.:nono::oi-grr:

true but assuming he isnt a dealer then he wouldnt be saying "AHAHAHA NAH FUCK YA BUDDY!" under the Consumer Guarantees Act.
so a statement that says "under the CGA you can say..... ...assuming your nt a dealer" is a paradox.;)

That & I tend to agree with the others, the clown has tampered with it, stuffed it & now wants his money back, pfffff to that.
Oh & one other minor detail...............he has already got the same bike so wtf is he going on about saying it isn't fast enough???
Something fishy goin on there guvna. Tell him to take a hike :nono:

I thought it might've been a case of him knowing how fast those particular bikes are, and the new one he bought isn't as quick. But that's completely beside the point.

Buy a big-bore kit for it and sell it to them for TWICE the price - tell him it will go faster then :woohoo:

I'm in the tell him to get f*cked category. A deal is a deal.
Now might be the time to get any photos of your kids bike together. Pix that might show the condition of the crankcases, bodywork etc. so if it comes to it, you can prove that he has made changes.
