View Full Version : Damaged bike and compensation - Insurance question

Hi. Just over three months back, some tosser reversed into my little 250 whilst it was parked and did a runner. Luckily, a witness saw this got the guy's rego and eventually we tracked the culprit down.

After two months, the culprit's company finally got around to submitting correctly filled-in forms to their insurance company (the 250 was only insured for TPF&T) and an assessor came over and okayed the bike for repair. The bike's been with the dealer for over a month now and the parts are on back order from Japan. Knowing Blue Wing, this means that they'll arrive sometime after Doomsday.

Considering I haven't had the vehicle for three and a half months, and I'm unlikely to have it for at least another month, am I entitled to any form of compensation for loss of a vehicle during this time? Can I rent myself another bike and bill the culprit's insurance company for the cost involved? It seems wrong that I should be deprived of the vehicle through no fault of my own, yet have to wear the associated costs.

Can one of KB's resident insurance experts provide some advice?

You will only get compensation for losses incurred. If you have access to another vehicle, you are not incurring losses in terms of getting to and from work in a taxi/bus etc. You can't rent a bike and expect the insurance company to pay for it if it's solely for recreation, unfortunately.
