Sorry for posting in a bike forum BUT
What would you do in this situation?
You live in Windy Wellington <?xml:namespace prefix = st1 ns = "urn:schemas-microsoft-com:pl</st1:City>
<st1:City></st1:City>A friend of yours is having some fairly major work done on their sports car by a specialist panebeater in Rotorua . You offer them the use of your sports car to drive whilst theirs is being sorted and for a period after this in case their car gives problems. You ask to be kept updated on progress with their car and how things are going with yours.
The car duely leaves with all concerned happy.
Your friend isn’t happy with your choice of tyres so fits their own personal choice.
Months go by You hear nothing from said friend. From a third party you hear that some minor damage has been done to your car.
Your friend uses parts from their car to repair the damage they did to your car. In order to keep yours on the road.
Still you hear nothing from your friend. <O:p
A few months go by and your friend crashes your car doing a reasonable amount of damage. Not major but none the less reasonable amount.
They then leave the car with the panelbeater in Rotorua who is working on their car. They announce to the panelbeater that they don’t want to use the car anymore. The parts borrowed from their car are quickly removed from yours as are their tyres. Your car sits on blocks as they have lost your tyres.they then walk out. <O:p></O:p>
A few weeks later said friend picked up their (by then completed) car and drive out.
3 months goes by and nothing has been done to fix your car .The friend hasn’t made a phone call to the panelbeater or to you to organize repairs.<O:p
Your car is still sitting on blocks with no wheels or tyres.<O:p
You call the panelbeater to organize work on another part of your car whilst the repairs and replacements are being sorted –This work happens in a timely order.<O:p
You make contact with said friend to ensure repairs are progressing and that your car would be returned to you in a reasonable time. The freind states “Oh I thought you and the panebeater had sorted it out” You make it quite clear that this is definitely NOT the case . You wait and still no contact and no repairs<O:p
Besides the fact clearly you have been a prize sucker and deserve all you got how would you sort this out?<O:p

Register some sort of lien on their car, or have it 'repossessed' until yours is returned to you in the condition it was when you first lent it, and at no cost to you.

Mind you I did a similar thing last year - a friend of my younger daughter needed a car while she saved to get her's repaired.And as she had loaned my daughter a car in the same situation previously,she asked if I could help....so I gave her one of my cars.She lives in Clendon,duh - one day all the cars in the street have their rear screens smashed,so now she has 2 cars to fix.Six months later nothing has been done - we organise a screen replacement,billed to her,and she supplies a new battery.My problem solved....and the girl is in even more financial trouble.By the way she is dying from cancer.....SO???

To my knowledge, your only possible recorse is to go through small claims court, unless we're talking more than five grand, at which point it becomes a differnent type of legal battle.
What would I do?... Probably better discussed via PM.

Umm, Frosty doesn't live in Wellington. I read this as a theoretical. I suspect someone Frosty knows has got this problem and has asked for help and Frosty has put it out to the masses for advice.
Of course, I could be mistaken.....

find the car and take his wheels (obviously they fit your car).
Then inflict the same pannel damamge done to his car as he done to yours.
Simple.

I gather their car is of the same model...so simply go and pick up their car and remove required parts and "invoice" them for the time/costs incurred during said process.
Has always worked for me anyway

Difficult one...I would see a Lawyer for an hour so it does not cost you too much and find out your options...(I thought the DT limit was $7,500).
No point doing same to him because it will just turn nasty and you need to keep to the rules to avoid finger pointing.
Certainly worth going down the DT way. Will not cost much and you having nothing to loose. If he does not attend hearing and Referee awards in your favour then you can go for an attachment of earnings as things progress and this is gonna cause him more grief.

'said friend' aint much of a friend.... is your car insured? Did panelbeater take digi photos by chance? You could make a claim through your insurance company for damages caused by said friend, making sure that you say the damages were caused in a single incident that you are aware of and name 'said friend' as person responsible for damage. Insurance should pay for damages and claim back from other party leaving you out of the battle. Of course having repairs done without the insurance company having the opportunity to view damages may predjudice the claim, but worth a call to your underwriter. Small claims court would be next best.

People have been walked over since time eternal. The happy ending to these stories is that now we always have a reason not to lend our things to others ever again.

Never lend stuff! Learnt this ages ago... Well, not if you want to keep friends, etc.. Nephew asked if he could do some driving lessons in my car (it's a manual) when I was 5 hours away from home! 'No, sorry. Besides, you aren't a named driver on the insurance policy'... works every time.
Sorry to hear about your woes, Frosty. I'd probably do the lien thing and/or talk to a lawyer and/or go to small claims...

Who lost the tyres, the friend or the panelbeater?
I might tell the friend exactly what I wanted fixed/replaced that I thought they should pay for and when I wanted it done by and then listen to their response.
From what you've posted, the only response from the friend is that they thought you and the panelbeater could sort out the damage.
Maybe they aren't aware of the extent or the cost involved in fixing it, or had different ideas about the terms under which they borrowed the car?
I'd like to hear the friend's side of the story.

Aparently the panebeater also is less than happy with the freind.

i lent my bike to a very good friend..
know that they would honur and damage... and if it was off the road i would have full use of thier bike.... ( no i wouldn't have taken up the offer of thier bike) untill mine was fixed...

Lent a bike to a mate once who crashed it in the most spectaclar fashion imaginable (ie his las vision befor he was knocked out was it spiraling through the air above him thinking if that fucker lands on me I'm a dead man). Damn thing bounced on its rear wheel (rooted that) then the front end (fucked that good and proper) and then embedded itself in a rock face so only the timing side was un touched.
He gave me $80 towards fixing it...
Cost me $60 from memory - was well pleased...

Gutted! They don't make friends in the way they used to in the olden days it seems...
What I don't get is that the owner of the car was informed through a 3rd party that damage had been done to the car. This is after months of not hearing anything from the friend who borrowed the car.
No action is taken and then a few months passes by before the friend crashes the car...
Why didn't the owner pick up on that? After months of not hearing anything at all, then a 3rd party damage report and then another couple of months before the bigger incident.
Seems odd to me. Not the way I'd lend out any of my possessions...
The inaction of the lender could become an issue if this turns into a legal case!

You need to screen your 'friends' a bit better (too late now, sadly).
I have some friends I'd lend my favourite rifle to.
I have other 'friends' who I would have reservations about lending one empty shell from said rifle.

It's starting to look pretty clear where the street is going to end up, people on this track generally have to take pretty drastic measures to get off this rollercoaster. Team up with the panel beater. You will be helping your friend in the long run by taking action against him - and helping everyone else out here as well. Good luck!

Thought those that are interested might like an apdate.
The "Car" has been restored to its former glory Thanks to the unstinting efforts of the "panelbeater" and his circle of contacts.
Id like to thank Billy way beyond thanks for the HUGE effort in making it all happen. YOU my freind are a fucking legend.
Message to KBers--DONT fuck this guy around He does quality work at a reasonable price hes a person we can't afford to lose.
Also OZZY he sorted out my forks once and for all and at a fucking unbelieveable price -If you ever need suspension work done on a racing bike--this guy really knows his stuff.
Also Shaun for offering to help out when things looked grim
And no the "borrower" has done NOTHING to rectify this situation.
