View Full Version : Well I knew my insurance company would manage to screw me

Bugger it as the title says.
Got home tonight and I had a letter waiting for me from the good guys at the Auckland City Council, enclosed was a Stationary Infringent Notice (parking ticket) with heap of crap about how it is legal for them to ticket me this way, blah blah blah yada yada. A closer look at the ticket me go WTF!.
The ticket was served on 17 June 2008 on Federal St in the City to a Suzuki Motorcycle with the rego plate 45YNE and I had failed to display a current licence label, $200 sir, thankyou very much for coming.
Bike 45YNE used to be my SV but was written off by the insurance company after an accident in March!!!!!!!
I knew my insurance company had been far to easy to deal with.
So I now need to get off this ticket, allready rung the council, they didnt really give a shit and said it was my problem. I will be ringing my broker tomorrow to find out what the f@%k has happend.
Can anyone give me some advise on how to procced, I have a bad feeling it is going to be a little more complicated than writting a nicely worded letter with a few scraps of paper showing that my bike has been written off.

The description of the vehicle on the ticket won't match your bike.
Point that out to them and they should drop it.
If your interested, I can run the plate, and see if the new Owners details have been loaded in. Perhaps the Council may have checked the plate before the new owners details were entered into the system.

Right now you are feeling a bit um annoyed, try ringing the insurance tomorrow and having a rational discussion, if you have any documentation that proves the bike was written off by the insurance company before the date it was tickets then try the council again, calmly and rationally, try going with perhaps the ticketing officer was mistaken in the plate number, or ask for a photo to prove the plate number so you can take this to the insurance company.

As far as the ticket goes, this one needs to be taken right back to your insurance company. Do you have a letter confirming they wrote the bike off?

If you have proof that the bike was written off by the insurance company, go in and talk to the counsel.
Sounds like the insurance has done a dodgy though cos if the plates had been handed in then it should have been registered to a new owner and yourt name should have no longer come up against that plate.

Contact your insurers. If it was taken off your hands then they are responsible for deregistering it or ensuring the change of ownership was done. It's not your fine to pay.
We occasionally get vehicles that slip through the system (particularly when Turners say they will deregister it and don't ...) and fines are referred back to insurers.
It's not your problem mate.

Thanks Grub I would be interested to see if the new owners details have been loaded in. I am supprised that the plate is even still live, my understanding was that after a bike is written off the insurance company deregisters the bike.

Carfax.co.nz says that the rego was cancelled 24 April 2008, Vehicle written off by Insurer.
I'd go to the Council with documents regarding settlement of your claim.

The ownership of it was transferred to the insurance company when they took posession of it, and this fact should be passed onto the council.
"I don't own this bike, and I am not in posession of it. Ownership of it was transferred to insurance company blah-blah on such and such a date after it was damaged in an accident. There contact details are blah-di-blah-di-blah - I have no further interest or contribution to make on this matter. kind regards, etc.

Yeah as we all would be and I am really good at getting un rational :eek:, seems like someone has messed up and its not you, calm and rational helps, best thing I find is set aside some time and be prepared to sit at the phone, as I suggested find out if you can get a photo of the bike when it was ticketed oh and the location, perhaps it was ticketed outside the repairer or insurance co's yard. More ammo is better.

Well been in touch with the insurance company today, they havent got a clue how this happened (no suprise there) but they do seem rather eager to sort the issue out.
They are working with Turners who sold the bike to find out what has hapened and will getting back to me ASAP.
Personally I dont care whos fault it is I just want it sorted!

I know that if you go to the post office you can get a form saying you didn't own the vehicle at the time of a speed camera and you get off.

There is a ticket on the bike, and it ain't yours, and you ain't responsible. When I get tickets... I can't say that they aren't mine... (well, I do try, but it never works) :whistle:
Don't get too riled up, you just have to tick the boxes, follow the process, and come out the other side. If it makes you feel any better, treat it like a game. They are trying to get you, and you're trying to get them... you'll get them in the end anyway ;)

here is a form on the auckland city website to fill out which basically gives you space to fill out your explanation, and if you use the pdf one instead of the online one you can attach any evidence (http://www.aucklandcity.govt.nz/auckland/transport/parking/vehicleinfringe.asp)
then you just chuck/shred/burn all their threats to take you to court over $200 until, 3 to 4 months later, they post back saying they were wrong and they'll let you off, but only just this once
they don't even post back to say they recieved their submission, so if anyone seriously asks for money tell em to shove it till they read your submission.
this is their process so let them suffer for it
if there is ever a practical use for cameras on cellphones that justifies the cost, fighting parking/police/insurance bills is it

Be careful - you could end up with your car (or bike) being towed until you pay the fine!
You must write to the council and ensure they receive it within the 28 days allowed. End the letter with "therefore a hearing is requested".
If you don't do this the law council are legally allowed to file the unpaid fine with the court - and the court couldn't care less who the owner is and have all sorts of powers to get your money.
Request a hearing within 28 days of the Reminder Notice and it is guaranteed you won't have to pay (although the process can be be somewhat time consuming as council/court staff aren't noted as employing much common sense).
OMG Turners didn't de-register it!?? They're good at that.
Yep, had an issue myself with Turners not making sure that the paper work was done by the new owner.

Funny you should post, another letter arived in the mail from ACC acknowledging the letter sent to them by turners and stating that they have fowarded the infringment on to the new owner and if they take responsibility I will not recive any further corospondence from them.
I am still not hopefull, if it was you would you take a $200 fine voluntarily?

why should they have to agree to take responsibility, they now own the vehicle, ergo its their fine.
I say fight them as you didnt own the vehicle at the time it was ticketed and they now have proof from turners. The new owner owns the fine regarless if they want to or not.

If I had all the paper work that proved it was a write off on said date ! I'd be sitting back waiting for the bayliff to come take possesion of it for unpaid fines ! Laughing the whole time !

Dont worry I aint going tobe the one paying the ticket, currently I am just going through the due process with as little effort required by me. If the ticket lands back on my lap at the end of that then it will start :girlfight:

if the new onwer thought he could dodge responsibility by not changing the ownership, just tell the council to tow/repo it.

i know im dredging this post up from the first page, but you can check this on the pprs register... you can txt in the rego and you'll get a response with whether it has anything against it, if it does then you can find out what using the code they send you

Perhaps I could have, but back then I knew that there was finance still owing so no actual point really. Once I have actually confirmed there is no finance owing, I will be posting a thread on here with some fairly serious warnings when dealing with the finance company concerned.
I am being a bit kind to this particular finance company, though I have no idea why really given the level of stress they have caused in our home over the past 2 months or so in giving them to the end of yesterday to release the security. Stay tuned!

I presume you got paid out by the insurance company after your accident? In which case you would've filled in and posted a copy of the "release form" back to the insurance co.
You should also have a copy of the release form indicating it was written off and the insurance co. are taking ownership/possession (whatever). If this has been done, then it's no longer your issue...if not then the insurance co. have on-sold your bike without your permission.
However, since you undoubtedly signed the form (and got the payout) then there is no need to stress over it.

Insurer gets it. To be simplistic when the insurance company write a vechicle off they buy it off the owner at market rate (or aggreed value) assuming pre accident condition. The insurance company then recovers its money anyway it can, cashing in rego, selling the wreck, etc.
