Hello all

I would like advice on how to go about making a complaint. I was taking a nice wee ride in Howick this morning and I turned right at the roundabout (it had just finished raining) to go down Picton Street. I'm taking it nice and handy as I know the road well and cars are always pulling out from parked positions and it being 11 o'clock on a Sunday .....
Crazy bint behind me starts beeping her horn and proceeds to overtake me....I speed up to stay out of her way, but she beat me to it and turns in on me......just missing me by inches.....I beep at her and try to overtake her (and see if shes pissed) but she swerves at me......so I hold back and follow her.
It turns out she was in a mad rush to plant an "open house" sign down the road. I get off my bike and ask her "what the fuck are you doing" she replies "You were going too slow" , "You should have moved over to the left".....After I picked my jaw off the ground I told her she missed me twice by inches, she could not have given a flying fuck...
Anyway she pisses off, and I take down her reg. and moble number (the stupid bitch pulled up outside one of her own Realtor signs, with various contact details and a hideous mugshot) I will not name her but if you live in Howick/Pakauranga area and read the local paper, she is in the Real Estate section and she is the spitting image of The Joker from the early Batman movie.
I didn't find a witness as it was pretty early and no one was around, I hope she has "previous" as she looks like a bit of a soak. I'll be going to the cop shop after work tomorrow.

Any advice would be greatful

I would have thought ringing *555 would be the best way to deal with it if you were wanting immediate action .......

Rip out her open home sign and chuck it away. Keep doing this for a month or two. At the very least you might feel a little better.

Ring the head offive of the real estate firm. lay a complant Tell them if you get no reply from them to your satisfaction you will hand the details to the police.
and papers.
You might get a fast reply.

But seriously....... Next time just hold back and let her go. Saves you stress and danger and you'll be a happier and bigger person for it. Only you can control the way you react to this sort of thing.

Sure,but take it with a pinch of salt.
I will presume you are new to motorcycling.
Why did you speed up when the car went to overtake ?
Why did you then try to overtake the same car after it had overtaken you ?.

One case (or two here) of bad driving does not justify the same bad driving in return.
Keep it up and you will end up in hospital or worse.

Make a complaint to the Realtor but from what i read it was bad driving/judgement on both sides.
You could have simply let the car go by,muttered under your breathe and carried on your way.

Everyone makes bad calls at some stage (including myself) but you need to learn from them (even if it is thought to be unfair)

Steal or deface all her signs (that will cost her),

Get your wife / g/friend and get her to make an appointment to view house.

Get her to gush that she loves it. Get her to get the Realtor all excited - they are really struggling for $$$ at the moment - so that will get her all happy, happy, happy.

Get girlfriend to say "I think Ill put in an offer" I just want to have my boyfriend to see it.

You go to the next appointment and say that you refuse to deal with her.

Walk away listening to her sobbing.

There's an online form on the police site which I've filled in a coupla times. I have had a call back from them about details so they don't just go in a bucket. I think if they get a few complaints about the same driver they pay a visit and talk sternly. And it may affect insurability...

If you search the forums you'll find the link - sorry, I'd me more helpful and do it for you but I have heaps of work to do and shouldn't even be on KB.....

I say you round up about 20 bikers and ride up to one of the open homes :whistle: look my punks so that it will scare potential buyers thinking the mongrel mob was buying the place..

I done it on a scooter before. They will send the offender a mail saying that there has been a official complain and gives them a warning.

That is part of the required protocol. At the end of the day, if the incident has already happened, then it is not going to get immediate attendence. If it is ongoing, then that is a different matter and will depend on unit availability.
At the end of the day, Police need a statement to be able to do anything about a traffic incident which has already taken place, and was not witnessed by a member of police. There is a REASON you are advised to make a complaint at the station OR on the police website.
Let me state the obvious...no ticket will be issued about an incident like this where no one was injured, and it was not witnessed by Police, but it IS worth making a complaint.

I'll hold my hand up and reply to the various posters that I did act stupid when trying not to get knocked off my bike yesterday, rush of blood to the head and lack of experience.....I've only been riding the past year or so, so yes I'll concede those to points that have been made.

Anyway its a moot point now because I crashed my bike this morning on the way to the cop shop.....A waste truck failed to give way to me at a roundabout (not the same one......) and knocked me off my bike.
I didn't recieve any injuries and superficial damage to the bike, RH indicator snapped, bent brake pedal, bent front brake lever. The truck driver admits total liabilty and I have two witnesses that gave me their contact details.
We both went to the cop shop (as I was going there anyway......) and filled out an accident statement.
Funny thing is I was going to go to the Honda shop at Botany to see how much I could get for my bike. I went there on Saturday afternoon to get a few bits and asked one of the lads about buying my bike. He had a quick look at the bike and said take it back in during the week as the Mechanic is busy, but "yeah, were after some 250's"........
The even funnier thing is my bike insurance ran out two weeks ago.....I have numerous reminder statements from them asking me if I want to renew it......I didn't because I spent two grand on an airline ticket and I could'nt afford to at the time......
I made a formal complaint about the driver yesterday, and don't bother flaming my ass because:

1 Lesson learnt re. my stupid riding.
2 Lesson learnt re. riding without insurance.

And by the way I'm not laughing.......

I wouldnt stress about it.

Just be aware that property market is in the toilet, so her flash car will probably be repossessed pretty soon anyway.

Not that I have anything against agents. oh no.

There was no catch 22 in your actions, you made all the wrong moves when confronted by an aggressive driver... probably worth considering what you'd do different, some that confront you like that will kill you.

/edit: But still, you could've punched her in the face and been on your way.

Friggin heck man.... exactly the same thing happened to me the other day! The road was soaking wet from a downpour so, I was keeping a good 4 second distnce from a huge van in front of me......... me and the van where at a conservative 50kph coz the road was wet and the road was a bit twisty and curvy. This stupid BEEAATCH was riding my backside like nobodys business and then overtook me on a median strip !and sandwiched herself between me and the van in front of me! she was so close to him he couldnt even see her in his mirrors! I was fuming so I gave her my horn. I caught up with her at the next set of lights and split up the lane of traffic to the front of the queue anyway. I wanted to put my fist through her window as I went past but just took a deep breath and left her at the lights. wow.... that was quite a rant.... thanks for listening folks. bottom line is.... you are going to encounter Aholes like this on the road almost everyday...... If you really feel like your life has been put in danger or, an illegal manouvre has been made by said Ahole *555 them or email "Roadwatch-report a bad driver" @ www.police.govt.govt.nz they will give you option of them sending Ahole a warning letter or, you can press charges in which case you may have to appear in court to give evidence.

Actually I quite like kicking off their wing mirror as I ride past their drivers door, of course helps to hand steel caps on. Basically ya pretty screwed on a bike cause if they bump you your on the road on ya arse

.... rough stuff to go through eh. Glad that you didn't get hurt.

I just accept that nothing is going to change car drivers, and it is my responsibility to try to stay out of their way. Luckily I have serious mistrust issues - riding my bike is one place that this really pays off.

I never go through a green light without checking there are no car racers coming, I never trust that anyone has seen me at a roundabout, even if they are looking right at me, and if a car is parked on the side of the road I prepare myself for it to pull out in front of me.

That all sounds a bit paranoid - it is! A friend was knocked off his bike this summer by someone who indicated to go left and instead turned right into his path. Cars are unforgiving - trucks even worse, so you have the gods on your side today.

I don't blame you for wanting to chase the person who cut you off; it's a gut reaction to want to educate them. But, car drivers are doing what car drivers do - they don't concentrate or think like us when they are driving because they don't have to, surrounded in their little cocoons. They are focussed on what they are going to do when they get where they are going.

We have to be focussed in the moment. I think that is why motorcycling is so endearing and we can be so passionate about it - because we are experiencing the NOW fully. It brings us out of trying to make the world fit us, how we think it "should" be, and teaches us to fit into the world.

Hmmm, she has a full right to overtake you (beeping was a bit wrong tho), no offence but why on earth did you then speed up while she was overtaking you??

Sounds like you need the complaint made against you...just because you are on a bike doesn't mean you have a right to be in front of all traffic and intentionally speed up and cause a problem that would have otherwise been perfectly fine.

Have you ever tried to overtake a car/bike? would you then want that person to start accellerating so you couldn't make it before courner/hill/on coming car?

Time to take a look at yourself.

Lesson #3: Opening mouth and inserting foot is not uncommon, so don't sweat it.
Lesson #4: Laugh, it could have been a lot, lot worse.

Most importantly, ride safe, there are even worse drivers out there than the one you just encountered.

Yes I've pulled my head in and greatful I didn't recieve any injuries from the second incident.
A salutary lesson has been learned and I'll crack on with fixing the bike.

Yossarian, I liked your last post very much. I hope you meant it, riding as you did is a fairly surefire way to come unstuck big time on a bike. I would suggest you look into taking, as a matter of some urgency a RRRS course.

Seriously Mom.
Pushing from the back - it just doesn't work.

Like you and Maha, he needs to lead from the front (not from an arm chair).
He needs to demonstrate the strength of his convictions and show people he is serious.

He appears to have an idea, were he to formulate and plan and put it into action I am sure others would get on board and help him make it a reality.
It's his baby, HE needs to run with it and stop trying to beat others into submission.

BUT only if he genuinely wants to effect change.
Though I seriously doubt this is his goal.

*555 for minor stuff... (will post out a form for ya to complete and write aletter telling driver off...)

Ring 111 for important stuff... this was probably important enough with her swerving twice at you, but this fellas own styles did leave a bit to be desired... (not you Planna - the threadmaker...)
