Sorry Folks... Long winded story...

So last Thursday night I was out and about... Had just left a meeting and was heading for the Gillies Ave on ramp in Newmarket, Auckland.

Pulled up at the lights on the corner of Khyber Pass & Crowhurst St and sat behind a station wagon. Light goes green, the wagon and I turn right in to Crowhurst, the wagon then turns right again in to the BP on the corner, I gas away from the back of him as he moves out of my way, look up in time to see a big 4X4 pulling out of the stop sign on Kent St and tryng to turn right. He sees me coming and promptly STOPS right in the middle of the road. By which time I'm going shit shit shit and jumped on the brakes and chopped her down a cog, road is wet, back wheel locks up and I hit his drivers side front guard, bike goes down and I step off it and think to my self "Why am I not in pain?" while I'm screaming from the inside of my helmet "You fucker" & throw my hands in the air. So I start to pick my bike up off the road and this clown gets out of his Remmers Taxi and tries to stop me... At this point I made the decision not to stove his friggen face in because I knew he was at fault and that would get me no where. He thought I was going to try and do a runner. I said to him "I'm putting it on it's stand, now get out of my way". I take my helmet off and decide to move teh bike off the road and again he tries to stop me GRRRR. By this time one of his passengers is calling the cops. there were 4 occupants in the 4X4 and they are all walking around talking in their own language and basically ignoring me... Which really gave me the shits. Cops arrive and before they get out of the car the cop in the drivers seat says "What happened?" I replied "He pulled out in front of me and I hit him" Asian driver of 4X4 says (accent included) "You speeding" Cop says "Shut up, you're going to get the ticket". So 1 cop talks to them the other says to me that every time a driver fails to give way they always try and say the other driver/rider was speeding. Took all the details and sent me on my way... As I was pusing my bike over to the gas station 3 of these guys are arguing with the cops that it's not thier fault... hahahhah

Cops came to see me at the station to tell me that I might get a call from the police complaints authority because they are claiming the cop made a racist comment when he told the driver to shut up.

This was a bit of a killer way to top off an already crappy day.

So I findout this guy is not insured and he's driving a 2 month old Toyota Highlander... Go figure. So I call my insurance broker and he tells me that my insurance has also lapsed but he will act on my behalf. They finally return his call and then ring me and ask that I get quotes for repairs and fax them through because they aregoing to pay to fix my bike.

Shit, I'm supposed to be dropping it off right now lol

Morale of the story... ALWAYS MAKE SURE YOU'RE INSURANCE IS PAID UP!!!

Insurance would have written it off and paid out the 6k I had it insured for because the parts are un-obtainable for a 25 yr old XJ900 :)

So I already have the parts and will have her fixed the day he pays me out :)

Main thing is that you're ok and that everything is sorting itself out.

I'm sure you're intelligent enough to realise that if someone is speeding it's rather easy for other road users to miscalculate the distance available to them.

And I would have thought the main thing should be that hopefully he's learned something from this.

Sorry to hear that! It looked so gorgeous on the BTPR ride too :(

It is a bitch when they just stop in the middle of the road. I had a similar thing happen (car failing to give way from a side road), and I made the same bloody stupid mistake -- hit the picks instead of swerving. Granted, it's difficult when they're taking up the whole lane and you have footpath on one side and cars on the other. But there's always options, provided you can think fast enough to choose one!

And you always pull the "fuck their right to remain innocent until proven otherwise - if the biker was displaying ANY forward momentum whatsoever it is clearly completely their fault, so I shall insert one of my generic comments right here" card. :rolleyes:

Glad you are OK. The XJ's were pretty solid. Still plenty of parts around for them too. Later model bikes could have done 6 grand's worth of damage to plactic alone. Glad the LAW is in your court...likewise the insurance Co.

I don't know about your bike, but I have to look down to see my speedo and indicators. He could also have been looking where he was going around the wagon, which would mean not looking through it at the 4x4.

I really love the post 'They *always* pull the racist card', does anyone else see the irony? :niceone: But I do agree with it, just like 'me no speak engrish', it doesn't take long to get sick of hearing that eh!

Had that shite happen to me while I was innocently speeding along. Loverly, friendly yellow F:angry2:K pulled out in front of me. pulled up beside him and he said that he did it cause I was speeding the accident would have been my fault.

Anybody want to buy a mercedes mirror?

Hmmm, if you punched him in the face it would have been HIS fault because he was a douche bag? Pity the :Police: wouldn't see it that way IMO. But yeah, it's because of people like that that we need laws against violent actions, cause if it weren't illegal who WOULDN'T yank him out of the car and :kick:?

And in a way he would be right. Too many motorcyclists are so far up their own arse - they can't see things from other road users perspective.

It's not his problem if you want to belt along much faster than the normal flow of traffic and imbed yourself into the side of a car. You choose to speed so you can deal with the problem of other traffic pulling out in front of you. Or slowdown to the normal flow of traffic.
