View Full Version : Lawyer to appeal new exhaust regs

Seems as though new regs regarding exhaust systems are due in soon, but these have been reworded by the govt so instead of every car (and m/c's?) being required to have an exhaust system with an 'effective silencer', the new rules drop the reference to 'effective silencer' to now having an exhaust in good working order that has 'some means of sound attentuation'

Seems this is too open to interpretation for our chch based lawyer who reckons that some steel wool in the pipe would satisfy the new regs, so he is going to appear before a parliamentary committee today to appeal the new regs. He wants only exhausts that are quieter or the same as factory pipes to be fitted on vehicles. And to add to this Tim Barnett has begun work on his private members bill to ban modified exhaust altogether.

While I sympathise with residents being kept up all night by boy racers with loud pipes it looks like my $1000 plus Yoshi might be illegal soon. It only takes a few rotten apples to spoil the bunch, and those of us that choose to replace our standard systems are going to pay the price because of a few idiots in their lowered single cam Hondas/Toyotas etc that screw the nuts off them trying to keep up with the flow of traffic. I know plenty of people with highly modified cars, they for the most part drive slow around town (nothing to prove, licence to lose) who also are going to pay the price.

Hmmm, no real point to this rant, other than to bring up the topic for debate. If this has already been touched on before on this site, well this is fresh news from todays paper regarding a lawyer acting on the behalf of concerned residents going to parliment today.

Ferking great.
Anybody know how this will effect big bore or stroked engines.
I mean if I ever get around to puting the 750 or 840 kit in my bike I'm not going to run a standard exhaust system.
Even more so because they can't be got anyway.

Hi there. Did any of these do gooders think what this law change will do to the economy? no more tickets for noisy bikes and cars auto shops going broke . i read somethink in the paper that said a Christchurch red bus was putting out 105 db at a stop sign so Mr Barnett better get his own back yard sorted out before he starts bitching about a few Bloody CARS and BIKES. why dont these do gooders do something about real problems like CRIME instead of pissing in our pockets all the time, about average KIWIS spending their hard earned money on what they want to.

I've had my bitch so have go to.

Tim Barnett would have to be the last person to talk about banning modified exhausts. I thought his interest lay in doing the mods :sly:

Maybe he should try banning the exhaust pipes on push bikes for the noise aswell

So those Harlies can get away with 200dB while us sitting on 80dB with aftermarket exhaust have to obey the regulation. this is just sad :ar15:

they should honestly make it objectively enforceable eg the dB system and not some "not louder than factory muffler" as I'm sure every bike's factory sound is at different noise level

just my 2 cent ;)

But seriously, I haven't really followed this, are you likely to be tested roadside for this? Or is it a WOF requirement? Can I just fit standard muffler for WOF then refit carbon noise monster when I get home?

so no more buying a cheap *quite* muffler from midas or whoever the fuck does exhaust as these are not OEM. Everyone would have to go back to buying OEM parts at some extravegant price. Example OEM toyota pipe was 1200 but local built one was 100. This will see the end of a lot of small businesses i think

I sought of agree to part of what he's going for, I used to live in a flat where my room would rattle when every some tin can went past which was really annoying - I have since moved.

Would not a better law to inforce be that the noise level has to be kept below xx db in residental areas after say 11 pm. That I would be more happy with.

A/ He won't be getting legal aid for his own litigation.
B/ I guess you don't get woken by barely muffled boy racers shit-boxes much, do you?
C/ If you are ever unfortunate enough to face serious charges, you won't be consulting a 'filthy lawyer', will you?

PS Sleepless Sunday morn about 4.00AM, some shit box getting wound right out, followed by the howl of tyres, rapidly followed by CRUNCH.
Music to my ears.

OE systems for cars in NZ are made here by Southwards, and built up one off systems for imports are made using these same components, they also produce, source and supply performance systems that comply - I really think the finger should be pointed at the likes of Repco where you can buy an illeagal exhaust system over the counter, same goes for most of the total crap found on boi racer cars,if these pricks didn't sell stuff that didn't comply in the first place we wouldn't have this proliferation of crap we have now.

would this include bike shops that sell yoshi's, over's, two bro's, arrows??......to me it's all how the cage/bike is driven/riden...if its tested to comply at a set DB and speed then the coppers can issue tickets for noise and suck driving....for example my bike when riden at normal suburban speeds is quiet, but if i decide to give it the gas...its over 100db...so if it was tested to 80 db at 55kph it would comply...then its up to me to keep it quiet, and i keep my nice stainless Yoshi

My brother in law is a fitter/turner at Southwards. He says when these regs were first proposed, Mitsubishi Motors told them that they could not certify that the Southwards exhaust systems would meet the same standards as the original Mitsi part (in other words, Southwards pipes would no longer be legal, people would just have to buy from Mitsi Motors, So sorry). Don't know if that went away or not. So it's not just the smaller shops that would suffer.
Another thing worth noting is that not much of the overall noise comes from the exhaust. Late model Falcons make more noise coming towards the sound level meter than going away from it (From B-I-L again, referring to Southwards testing of ORIGINAL exhaust systems to see how their own pipes measured up)
In my own experience (just had my hearing restored via a cochlear implant) tyres (especially 4WD off-roader type tyres on coarse chip) is a huge part of the noise package

You might find the big name brands are built to a standard, they meet some certain criteria, but maybe not sound - if they don't comply with noise levels you may find a discrete ''not for road use'' label somewhere.Kinda like the 100w H4 bulbs, you can buy them anywhere, but they are illeagal and it says so on the packet...who cares eh?

Some of the loudest vehicles on the road are the big trucks, are they gonna "do" them? I doubt it.

Would a cop pull over 20 Harleys and ticket them? I doubt it (unfortunately)

This is such bullshit.

oh no. Just when we thought we'd seen the last of this slop from idiots in power. We should make a distinction between good lawyers and flithy lawyers however.

Good lawyers are moral people who are there to help people get through the legal system (and yes, make a buck like the rest of us) but are not out with an axe to grind.
Flithy lawyers/MP's (I knew there was another reason I didn't like Tim Barnett) are out there to make a ruckus and generate an 'ambulance industry' for their own glorification and the padding of their wallet. Flithy lawyers/MP's most annoy me cause they seem to have their head in the sand about what their actions do to other people not in their immediate vicinity - in a word SELFISH.

Maybe we could add it to the KiwiBiker lexicon, right before "gargre".

So are the Traffic Reg's 1976 being repealed ?

One of the schedules stipulates dB levels for different vehicles already - why do fuckwits have to introduce new rules when the current ones are not being enforced.(not that I want them enforced on bikes - its a safety issue)

See below.

[[Schedule 1
r29(2)
Maximum noise output of new vehicles
1. In this Schedule,—
(a) The term “gross vehicle weight”, in relation to a motor vehicle, means the weight specified as the gross vehicle weight of the vehicle by the manufacturer thereof:
(b) The term “power output”, in relation to an engine, means the net power produced by the engine, measured in accordance with International Standard I.S.O. 1585.
2. When measured in accordance with test methods laid down in British Standard 3425 or in I.S.O. Recommendation 362, the maximum permitted noise level shall be—

Noise
Level
Vehicle Type dBA
Moped 77
Motor cycle having an engine capacity of 125 cm3 or less
82
Motor cycle having an engine capacity of more than 125 cm3
86

These levels also apply to any vehicle that has had its exhaust system modified.

Now Im sure I saw stamped on the side of a 'standard' K5 GSXR600 muffler that the noise output was 91dBA (stationery test which isn't the BS Method either).

Bringing new rules in is often just is pandering to public outrage. What a load of shite.

I've also been advised by the LTSA that the police can issue a $150 fine for excessive noise from a vehicle - the assessment is subjective (opinion of the officer) taking into account the condition of the vehicle, time of day etc.

How many cops do you know who have enforced this on the boy racers ?
