Hope this isn't a re-post, did a search but what do you expect when put "pull over legal" etc into the KB search engine.

When one is pulled over, but is next to a long stretch of yellow lines on the curb, can one pull over anyway?
Just interested to know as if I see the flashing red and blues behind me, I don't want to seem as if I'm resisting it by looking for a clear bit of roadside to pull into, nor do I want to get done for parking up where I cannot legally do so.

Same goes for similarly difficult situations, as in the middle lane of traffic, or on Christchurch's narrow, 2 lane southern motorway.

Yes.

Obeying the instructions of an enforcement office is a valid defence to stopping where forbidden

The question of what to do if a cop wants you to stop in a dangerous place is bit trickier. Generally however one would assume that if it's dangerous for the bike, it's going to be more so for the cop car (I exclude being stopped by a bikie cop, cos they don't do stupid shit). So just make sure he's going to get hit first.

You stay on the road - even if that means getting your bike taken out by a passing truck.Taking a Cop to task on this matter cost me a day in court and a fine back in the bad old MOT days.

Mint, so even if I feel that the cop car might be causing traffic to stack up, I do have the defense to fall back on? Perfect world they'll see this too but hey it's life.

I was pulled over in Chch on yellow lines, so I kept driving for about a km until I found a safe place to stop. I drove slowly near side of road, so he didn't get paranoid that I was ignoring him or was not going to stop.

He never said anything about me continuing on til I felt safe to stop so I figured that was what I was probably supposed to do.

Put on your left indicator, keep well left and drive on to where it is safe for you to stop. Although it may be gratifying to stop in the middle of your lane and hold up traffic, I'm sure that you and the cop would agree that both of you should stop safely rather than immediately.

exact same thing happened to me in Auck. just chuck on the indicator and park in the first safe spot you see. the copper will understand.

In the Buller gorge they don't indicate - they just pop a U turn in front of you and take you out.

When it happened in the cage i just drove till i could find a park, cop was happy. but then again i got the ticket, maby he wasnt?

Give em a wave and point up the road or something. Either was as long as you acknowledge that you know they're there and wanting to pull you over you won't get in trouble for carrying on to a safe spot.

I got pulled over on my cage in the motorway during roadworks when there was no shoulder and ended up having to go over the harbour bridge and slightly round the corner before I could stop. Cop even thanked me for it when he came up to my window.

yeah it's all good, cops after all are human you know, and they generally are'nt stoopid enough to give you shit for finding a safe place to stop (they do get reprimanded for shit like that you know, plus they don't particularly like being a wall for cars to smash into) as long as you make him aware you realise they're pulling you over they should be cool, flash an indicator, point up the road, wave/whatever remember they do the shit day in day out.....they know what goes on.

Oh yeah, if you pull over where your not supposed to, that's cool too, you are after all obeying an officer in doing so, so no you won't get in shit for it.

It is your right as a human being to stop where you feel safe. In the city you find the first safe and preferably legal place to stop, I mean how would you feel if the copper got hit by another car just because he pulled you over?

If you are driving late at night and it is just you, you can call the police and ID the vehicle before you stop if you feel unsafe etc I have heard of cases where people imitate police cars, pull people over in remote areas and than nasty stuffs happens. That only in the States though......

Cop did not mind when I drove another km to pull over, It was either that or pull over into the ditch :)

They understand :) Its their job to do the whats best traffic thing..

i was asking myself the same q one evening. going along by the river which has dotted yellows. roadcones down the middle of the road, a few cars, and a sirening ambo coming up behind me. i just shot up the first side road i came to. got me out of the way, and hopefully helped the ambo get whereever it was going quicker.

i was pulled up on the desert Rd a couple of years ago... i took about 5ks to find somewhere to pull over safely, left hand indicator on all the way, cop said nothing about how long i took... just wondered why i was going 125k/hr........ was i ??? i have to belive you as i don't look at the speedo much... thats to dangerous:bleh:

I've been pulled over a couple of times. both times in reasonably safe spots.

I understand that you must pull over when signalled to do so by one of the blue and yellow brigade but I was always under the impression that the onus was on the rider to pull over at the nearest safe opportunity. I would say as long as you indicate you wouldn 't go to far wrong. Then again there are some total losers out there and it may come down to how they felt when they got out of bed that morning.

When a cop signals to pull you over you HAVE TO STOP THERE AND THEN. throw on your picks and stay kinda to the right side of your lane until you are nearly at a standstill then move to the left, then when the commy driver gets out you can say "hey wtf mate? tailgating is illegal!!!"

This is totally right, you pull over when signaled to no matter what. They normally don't put the lights on till they think its safe anyway.:msn-wink:

the law is that you "must pull over as long as it is safe to do so, or as soon as it is safe to do so", any fight in court that dosnt involve you doing 160 and turning down several back streets will be won

On the one occasion I was 'lighted' from behind I signalle4d that I was aware of the cop and then found a safe place to park up.

If it was me I'll keep goin till I find a safe spot, flick your indicator on and keep riding till its safe to pull over. If that means going another 10km so be it. Ride slow so he know what your doing.
Im a STMS (Site Traffic Management Supervisor) and if your parked in the live lane or on the road reserve your meant to have cones and all sorts of shit to minimize the risks. Parking up ther to get your ticket is just stupid and defeats the purpose of traffic management.:nono:

Sorry but no cop is going to stick me or my baby in the way of a tonne and half of cage doing 100kph. :oi-grr:

I was in a cage when this happend to me in chch, was going round the roudabout over the now closed overbridge by hagley park, cop turned on his lights and sirens just as i started into the roudabout, so i continued driving slowly over it till i could pull over on the other side and not block traffic, and she absolutley bollocked me for not stopping as soon as she signaled me to! :angry2:
I mean serioulsy stop halfway onto a roundabout? i tried explaining why i did not stop, she did not care and threatned to ticket me for trying to do a runner lol

i think she was on her rag?

Ah, it was a SHE :argue: If you got the ticket would you have taken it to court or written a letter of complaint against said officer?

There is no point of have traffic control i.e. Cones, dayglows, flashing lights blah blah blah if not EVERYONE working on the road follows the rules. Cops are not a rule unto themselves Im afraid :dodge:
Main thing is to use your head and pull in someplace safe.
