Yesterday in christchurch I got pinged $460.00 total for three fines - no wof notice, no reg notice and parked on broken yellow lines. Now - is it wrong to have wof and reg under the seat, as last time I checked it was acceptable and its the wof inspector that stuck it there. Also if parked at the end of a row of cars, it is not outside the said carpark is it, if on the white park line. I have written a two page letter of greivance to the council this morning and issued notice of the fines not being lifted, me taking them to court (mediation or a tribunal). Am I doing everything correct? Happened yesterday.

How is the council worker ... or police or anyone meant to see your WOF and Reg is you don't have them displayed. You will win as you had them ... but under the seat seems to be a damn stupid place for them ... as legally they have to be on display. Issuing notice to go to court seems rather silly ... all you have to do is evidence the fact that you have them and they will be waived ... this can not be done in a letter .. cos why would they believe you.
Give your council a call ... the call centre staff should be able to help or put you through to someone who can help you as to how to deal with this.

This subject was looked into I think by Fairgo or some programe like that..
Putting them under the seat is real dumb as as stated they are suppose to be visable and easily seen

You will win as you had them ... but under the seat seems to be a damn stupid place for them ... as legally they have to be on display.
And on display they weren't. The tickets will be for failing to display current vehicle licence and failing to display current evidence of inspection.
As for the parking infringement, hope you got a photo.

The problem is they normally let you off once you get it ... so there is a good chance .. :)

I got sent a 1st reminder over 3 months later to pay a parking ticket but did not remember even getting the ticket... when I queried the time frame they said tough luck we can do it when we want

The problem is they normally let you off once you get it ... so there is a good chance .. :)
How is that a problem? He claims he had them and admits they were not on display. He was ticketed for that, just as would any vehicle be.
Councils will rarely cancel the infringement notice because it is easy direct income for them. Police however are more interested in compliance (in the event your evidence of inspection and vehicle licences had lapsed, which the OP claims they hadn't anyway) and will, at the issuing officers discretion, permit a period in which if you bring the vehicle into compliance they will cancel the original infringement offence notice.

Ummm in a WoF holder. I usually bolt it to the registration plate, if I display it at all.

On some bikes it is not so easy to comply. :nono: John.

maybe time to invest in a couple of holders and screw thm to back of number plate...even if half covered in road shit ,they are still classed as been displayed...however as the rest have said...you should get off turn up even with bike and show where testing station have fitted them...but let them know you are changing their postion to the outside of bodyframe

on my daytona I have both on the rear but wife's cbr has rego on rear and wof on screen

Years ago when I did my test, the MOT cop walked around my bike and said, you dont have a WOF, yes I do, it is under the seat see? Oh, OK then off we go. Currently my WOF is displayed behind my number plate, but my rego is in my riding pants pocket :pinch: The old rego was stuck to the rear guard, on the paint! I peeled it off when I went to replace it. New rego is one that needs a holder, I dont have one, so for now the holder is my pocket. I guess one day I should go and get it sorted properly.

Unlike cars, there are no prescribed positions for their display on motorcycles.

On the "failure to display" infringements, you're dead to rights as far as I can see (you weren't displaying them), so the only options worth pursuing are: take it on the chin; or grovel.
The parking on yellow lines thing might be worth a fight. Come on, mate, do it for the benefit of your fellow bikers! I'll be cheering you on all the way.

On my daytona i have both on the rear but wife's cbr has rego on rear and wof on screen
no motorcycles have windscreens, we have wind deflectors and there is no legal requirement to display them on the deflector.

in total, all written out one minute after the other, I think the parking officer was just being grumpy at the end of a hard day. If I was to have been pulled over by a cop and they looked for wof and reg, they would just look on their database and everything would have been hunky dory. I really dislike these fines as the bike HAD both requirements, and why should it be fined for abiding by the rules. On my bike it is hard to find a place for both components to be displayed in plain sight, and yes I should get some holders, but the logic of pinging for no sight of a warrant and rego is just trivial. I am 19 and don't have anything to loose in life except life and my bike, so I will be fighting all the fines for as long as I need to for them to be lifted and a letter of apology for wasting so much time is issued. You guys may not agree, but hey, I don't agree that I should be pinged 400 for not showing 2 pieces of useless paper in plain sight. - rego and a wof sticker won't make a pillow to hit the ground with. And from having rego and wof current, I do not disagree with paying for rego, or getting an external saftey evaluation of my vehicle.

Be good if it were up to you, but will wait a week for them tp post out a replying statement, as thats how it works apparently. Oh, and thee are the infringements for the wof and reg, I quote: "Did use Unlicensed Motor Vehicle" and "No evidence of Inspection - Private Vehicle Warrant of Fitness". For the wof I am going to argue that there is evidence, the officer just did not see it at the time of ticket.

Yeah. It seems to me if you get the fines waived without the letter of apology, you might want to quit there.

they don't apologise and go through all the steps, they won't learn to not crap on the people trying to abide by rules as best they can. I don't want to be a prissy about it, but I got 4 hours sleep last night thinking about how much they want me to pay for two pieces of paper and plastic.

mount them on the bike, take pics and say they were there all the time and the officer must of overlooked them and show the expiry dates with pics...
may pay to mention that sometimes it is hard for the officers to see where they are on bikes as they can be mounted in all different places on bikes

The law is clear they must be visible, how ever the law is an arse as it also states that the inspector must stick the WOF sticker to the vehicle (as I was informed) when I complained about mine being in a position under the seat.
Get some holders, point to the rules re the sticker under the seat, and place the Reg behind the plate on an angle, thus it visible if looked for, and claim the ticket issuer cant have looked hard enough.
Give up the hope of an apology it wont happen.

Not true. I got an apology (of sorts) for Auckland City Council ticketing my car that I parked in a "goods service vehicle only" loading zone, once I pointed out that despite the fact my vehicle was not goods service at all, they couldn't ticket it because of a technicality.

Sometimes a company is too slow and their domain name gets in to the wrong hands. If you are the company that enforces parking tickets this can leave you open to a whole world of fun...

BTW I see your location is Hamilton, if it goes to court it wont be for a few months, and you will have to travel to Christchurch for the case. Is it really worth that too?

send a picture of your bike with reg and wof....(and proof you had wof and reg..)
Then ask how council failed to see it?
They got proof it wasn't on display?
The law wants us to have wof and reg as you mentioned.
That is fair enough.
However for the council to fine you $460, for simply not displaying the stickers is downright wrong.
As mentioned in some posts, the police should deal with these issues, and they are more reasonable.
How come councils have these policing rights?...,and how can they be revoked?
Good on you for not just bending over.... make them work and suffer.

The parking officer apparently drew a diagram explaining the broken yellow line fine, but it wasn't in the letter they sent telling me I had no evidence to have the fine waived, so I rang the Inspections and Enforcement Unit and requested they send me a copy.

So presumably you told them that they just missed seeing it, because otherwise you don't have a leg to stand on.

take what you have and run....pay the parking one and bite the bullet...
you are on a winner at the moment with the reg and wof ones... ccc parking don't usually go against there officers for parking unless you have photo evidence and 20 eye witnesses who all had cameras and took photos as well...
at the moment it's your word against theirs...

Nope - I told them it wasn't on the bike, but the wof had fallen off a few weeks ago (which is true). And since I bought the reg off the net, it didn't come with anything to attach it to the bike. If its their word against mine, are we still not on even grounds? I'll see what the diagram the officer drew looks like first.
