So I was pulled over for allegedly doing a 30cm high clutch wheelie today...uphill pulling away from the lights @ less than 50kph. The cop who pulled me over was the best looking policewoman I have ever seen...cute tall and leggy with a nice hungarian accent. She said she didn't want to charge me with careless use of a motor vehicle but she obviously didn't want me to miss out on some sort of charge because she spent 20 minutes hunting through her revenue book looking for something to drain my wallet with. She didn't find the charge she was looking for...she even called a bike cop to assist. The bike cop guy didn't give an inch...he wanted to charge me with careless as any wheel off the ground even an inch is careless use. Interestingly I asked him if I had to emergency brake and my back wheel came off the ground an inch would that be classed the same? Damn straight it's careless use. I would of been going too fast for the conditions in the first place! I'm sure you're thinking WTF??? how do I know when I have to emergency brake? Well sorry I didn't want to point out that he was a prick so I didn't ask. I was in full nice mode trying to get out of a ticket so I didn't think pushing it would be productive.
Anyway the end result was she gave my license back, wrote down all my phone numbers and said if I do get a ticket it will be an instant fine not careless use. As long as she can find out what the charge is!
She thought it was excessive accelleration or similar...anybody heard of this? Anybody know what a charge would be for a wheelie er...alleged wheelie that was not impressive enough for a full on careless use charge?
Any idea how much entertainment tax I may have to pass on and more importantly...how many demerit points? (I don't have many spare demerit points!)

This sort of thing is bullshit. So your front wheel came off the deck, taking off from the lights uphill?
I thought the road rules were all about safety? If you weren't obviously showing off, and were in full control of your bike, so fucking what?!?
Although what wasn't obvious from your post is whether the front wheel popped up unintentionally, or it was deliberate?

the other interesting part of the encounter was when the Bike cop saw my radar detector and (i think) he thought that radar detectors in general didn't detect lasers. He asked me to turn it on so I did...and the radar went nuts (as it does with lasers). He then said oh well you are not going to hear or see that at speed are you ho! ho! (sort of talking to the female cop). Then the female cop asked what was that flashing light in my helmet.

Although what wasn't obvious from your post is whether the front wheel popped up unintentionally, or it was deliberate?

No I sheepishly (I was still trying to project innocence) told her that it was there to show me when the radar detected something... and she burst out laughing...the bike cop didn't laugh though.

when she took you number ya shouldve asked for hers, and said youll even pick her up on the bike! Ive done that, got a stern "Im trying not to laugh" smile and she told me to carry on. wasnt bike related, but still funny. never saw a ticket for it though!!

I take from this encounter that the male kiwi cop was a one eyed full-of-shit wanker who could only see as far as his quota and the exercise of his power,and the female european cop was reasonable and interested in safety.
-as you would expect.

They can do you for excessive acceleration but there also needs to be an accompanying charge (i.e. they can't do you for that by itself... there's a thread on that somewhere in here).

I'd wait and see mate. A pain in the bum but there you have it. Maybe she just wanted your number... bike.. nice guy... eh eh eh???

I got pulled in the UK. for similar. The penalties were much harsher. They went for dangerous driving! I went to court and argued that as I do a lot of dirt riding, I spent a fair amount of time on one wheel. That I could brake, accelerate and steer whilst on the back wheel. I was therefore 'in control'. Got it reduced to careless with a small fine, 'dangerous' would have been a much bigger deal what with insurance (compulsory there) and much bigger fine. The prosecuting cop was lost for words when I put my case to the judge. His face was priceless. He he.

Anyway hope you don't get to see a ticket this time.

Is there any form of defence for being accused of something like this?

Secondly
There must be something other than an intended wheelie to cause the wheel to come up...

Say I'm pulling away from the rest .......... causes the wheel to come up.
- accidental or un-intended over acceleration
- oil / coolant patch causes momentary acceleration then tyre grips
- missed a gear change, dropped the clutch caused accidental...

Now all this assumes you put it straight back down again.

Being silly I know but it does happen.....
- Going over a pot hole can cause the front if not all the wheels to come off the ground and lose contact with the road surface.

Is a momentary, short pop of the front wheel i.e. getting it off the ground really a Dangerous driving charge or a careless use charge?

It is on the impound forms etc...

If she didn't ping you at the time she can't do you with it... it's not just a fine its a impound vehicle go to court etc...

she has missed her chance.

Unnecessary exhibition cannot be charged if no other offence occurs. Since 50kph was not exceeded, and she has not gone with careleess, she can't use unnecessary exhibition.

I _may_ have accidentally lifted the front wheel when I was learning. I'd forgotten to push the choke in, so my vt250 was running roughly. I was taking off uphill from the lights, and almost stalled - quickly grab the clutch and give it a rev, then quickly release the clutch so I didn't fall over ... it got a bit dramatic for a moment :-)

I assumed that since the system allows for learning on a public road (that's why I had a learner licence), some level of incompetence is expected and therefore tolerated :-)

For future reference I believe all the police cars now have a mobile number in the rear quarter window...

Basically a "ring the driver of this car on this number" - so that if the car is unattended you can call the cop who is presumable near by

You could have grabbed her number from there...

Of course if you see her in the car again somewhere...

I'm constantly erked at the unbalanced fact that police are believed over and above citizens/humans by default !!! WTF? It would be reasonable to doubt the officers accusations acuracy simply by countering the accusation with a denial!!! REASONABLE DOUBT ! DISMISSED!

That was a few years ago now. Just recently he told me he thought "that's it - she'll never get on the back again!" Then realised I was laughing like a lunatic. :banana:

When I had the FahrtSturm, I remember a couple of rides where I had the vifferbabe on the back, and accidentally wheelied the thing. One of those occasions was like the one klingon mentioned - and I had a lot of trouble trying to keep the front end down doing a hillstart at traffic lights on an uphill slope.

It's actually quite reasonable from a legal point of view: in cases like traffic offenses (sorry - "alleged" traffic offenses), the police are deemed to have no personal interest in the case, and therefore no reason to lie. OTOH, the defendant has every reason to be dishonest.
Unfortunately, (over)zealousness or ticket quotas to meet could actually mean that in certain circumstances the veracity of an officer could be in question, but even the evidence of other witnesses may not be enough, unless there is corroborating evidence.
