View Full Version : Excuse me sir, why are you taking pictures of my bike?

Blackshear
25th March 2009, 14:13
So as I was working today, in Takapuna... I was filling up the apple display whilst working my awesome job... When some feller just walks in a pre-meditated-like manner, comes right up to my bike, takes two pictures, and makes like a collective group of aviary-ian creatures. One of # plate, one of the right hand side.

I can't recall getting tooted at this morning, so pretty sure I didn't piss someone off... Wasn't an official person.. And no, I was not illegally parked.

Someone's taking meal pictures, for the local dining clubs menu, right?

:(

I don't think you understand Asian supermarket owners. They would keelhaul your ass for even THINKING about throwing an apple perpendicular to the crate/display.

Just scanned and found my bike not on there :Pokey:

I just figured my bike wasn't an MV Agusta/RC211V sorta thing... SO GET AWAY FROM MY BIKE WITH THAT CAMERA DAMNIT!

The too-sensitive bike lock will have to be used from now on, and the noisy garage door closed at night <_<

Yes, my baby is still my baby at present.

Mate, if I saw someone doing that, I would smash them in the face, and take the camera. what the fuck right has he got taking pictures of your bike, let alone one of your plate? thats just dodgy. Id punch for the face first, and ask wuastions later, like when hes on the ground holding his face and youre threatening to stomp his balls. Id be getting extra security for your bike quick smart biddy, I cannot think of a single legitimate reason for him to take ANY photos of it, let alone the plate. If he had a complaint to make, he would have rung *555

Hmmm seems a bit dodgy, Legally he is allowed to take a photo if it was in a public place so bashing him wouldn't do much except get you an assault charge. Might be a good idea to make a note of what he was wearing and what he looked like in case something happens to your bike later on. Hope nothing does.

I was somewhat perplexed at the fact someone took pictures of my bike. Was also in a big rush trying to get shit done before 12. Didn't realize 'till after the possible severity of this amateur photographer.

Although my bike is purdy, the way he walked was just... Well. Like he knew it was there already, and deviated not from a walking line, as a normal pedestrian would, to then take a photo after deviating. I dunno. Might ask the mechanic lads next door iffin I can be parking in their staff parks.

If the photographer stands on public property they can legally shoot what they like.

It sounds like this guy was on private property (albeit commercial premises)?

It is parked out front of the store. Unsure as to where the line is drawn, though. There are no carpark markings where it is, and it's about 2.5-3m from the footpath. This would be interesting to calrify for future purposes.

Yes. I was inside the store, at the back, and had a fairly unobstructed view of my bike. If a person was crouching next to it, that would be a different story.

Cheers for the ideas, ladles and jellyspoons. I will be disc-locking it at the very least tomorrow morning, and moving it if possible.

I'm glad my bike is noisy. It's a security measure in itself. Doesn't provide more than 2 seconds warning anyway, but still.

I get lots people (esp. tourists, who already have cameras handy I suppose) taking photos of my bike outside work. I suppose it's old-fashioned-looking enough to be interesting for non-riders, yet isn't in any way old or desirable enough for me to be even remotely worried about people stealing it.

At least every other week there'll be a new busload of Japanese tourists (they park further up the road outside Mövenpick) who want to get their wives to straddle my bike and have their picture taken.

i often take pics of bikes i see, same goes for nice cars. i try to avoid getting plates if i can, but sometimes it cant be avoided. spots like cemetary circuit parking and other race parking are beaut spots for seeing some nice rides. [and im crap at moving photos... all i get is mega blur]

99% of the photos i take are for my own collection and dont generally get put online. if they do, its under a private password protected account that no one else can get into.

He was in the 'drafting spot' of my rear. To be honest, 2 more meters away would be 1. just as legible, and 2, far less conspicuous.

Don't get me wrong, I'll take a picture of a sweet looking bike, too.

Wouldn't worry about it much... if he'd wanted to nick it he'd have brought a van with him... and if he wanted the number plate for your address, he'd have just memorised it, seems unlikely that a thief would bring unnessecary attention to themselves by taking photos.

Issues? yeah Ill tell you my issues, in the last ten years, 6 times vehicles have been stolen from a property that I was living at at the time. Three times we found out via the police later that the vehicles were stolen to order. Yeah I have issues, issues with theiving scum, give me ONE good, realistic reason why somebody would be taking photos of the plate and the bike? the bike, maybe he liked it and thought it was a nice bike, but the plate? cmon mate, read between the lines here, You wouldnt be particularly pleased if I walked up you driveway and started photographing your bike or car.
And for the record, unless you have a gate, which is at all times closed, for the purpose of the law, a "public road" is anywhere the public has physical access to, WHETHER BY RIGHT OR NOT, and that includes your driveway. hence why you can get done for doing burnouts on your driveway.

Wow... caffeine must be in short supply. I don't have problems with someone taking a picture. WTF. I'd go up and have a chat. The times I've done this I've found it's no big deal.

1/ He could have had an issue with the rider's riding style and having a camera on hand it's easy to take down details.

2/ Did he actually go up and take a photo of just the plate or was he more taking a photo of the rear because he liked the look. You could well have a person who liked the bikes and likes bikes.

3/ he may have had a bike stolen and was taking pictures to go back and check to see if it's his with a new number plate, or already knows it is and wants the photo proof for the cops.

It seems to me you assume the best, go up and have a chat like he's another biker or prospective biker. If he has a valid reason then all good and if not then...

To go up and thump someone because they took a picture of your bike seems OTT, and just gives everyone a bad look.

If someone had wanted to steal it, it would have been gone and noone would have suspected a thing.

If they wanted the plate number there are less obvious ways of recording it, for fucks sake they are only 5 characters long, and why would you take two pictures? the plate details will give you the colour and make plus warrant and rego details.

Maybe the person liked something about the bike, maybe he is planning on buying one??

Public carcark at a public shopping centre or on a public footpath... Ummm... three clues there......

.... in the last ten years, 6 times vehicles have been stolen from a property that I was living at at the time.

You need to live in better areas....

You wouldnt be particularly pleased if I walked up you driveway and started photographing your bike or car.

This isn't on private property

Not quite.... If there is a definable boundary, whether fences are up or not, makes it an enclosed yard.

Where did ya learn one can get done for doing burnouts on ones driveway? This is breaking news.....

Even a "public road" of this sort is still considered "private property" for the purposes of determining whether you're allowed to take photos from where you're standing.

Public road is a public road.

Depending what the photos are of. Taking snaps of the Mrs getting naked at 11pm at night is a no no. Taking photos of a vehicle or a building from a public place is fine.

The perpetrator took a pic of the BACK and the right side,

This means it would be :moon: and your right side.

Geesh!!!!

Public carcark at a public shopping centre or on a public footpath... Ummm... three clues there......
Good call... However, the OPs reply to my post suggests that the part of the "footpath" the bike was on may not be public.

Public road is a public road.
I may be wrong but the way I understood it this definition only applies to vehicular matters. I think the local council's survayors would probably agree that a driveway is private property when you're on foot.

Depending what the photos are of. Taking snaps of the Mrs getting naked at 11pm at night is a no no.
While very suspicious, if said Mrs is clearly in view while the protographer is standing on public property I've been lead to believe this is legal. That's how the paparazi get away with it. Or is there something about the person being inside their home?

You've gotta be quick with the trousers in a situation like that, park yer bum with a nice down trou in between the camera and the bike.

If anyone complains, just say your pants slipped while you were taking your leathers off.

Well, if a photo was taken of me from behind while naked, it'd still be able to see my willy hanging below my knees... But, I ride a Gixer, and not a Hyosung...:girlfight::banana::girlfight::cla p:

Nah... it means that the water is cold, there was major shrinkage and they are taking a photo to show everyone for a laugh....

Fairy snuff....

A private driveway is still a private driveway, and is expressly excluded as a road in the Land Transport Act.

Peeping and Peering into dwelling houses at night - Summary Offences Act.

There was a thread or a post somewhere recently on KB, about a bloke naked in his home, seen by a woman out on the street = he gets locked up for exposure.

Another lady naked in her home, seen by a bloke out on the street = bloke being locked up for peeping and peering.... Go figure.

Us blokes are doomed. Damned if you do, damned if you don't...

I dunno about everyone else, but I'd rather be damned doing it.

Were those two cases both very similar? I.e, the man pressed up against the window all day, in both cases?

Mate, if I saw someone doing that, I would smash them in the face, and take the camera. what the fuck right has he got taking pictures of your bike, let alone one of your plate? thats just dodgy. Id punch for the face first, and ask wuastions later, like when hes on the ground holding his face and youre threatening to stomp his balls. Id be getting extra security for your bike quick smart biddy, I cannot think of a single legitimate reason for him to take ANY photos of it, let alone the plate. If he had a complaint to make, he would have rung *555

you

are

an

idiot.

You are probably one of those people that would shoot someone and be like "I didnt mean to kill them", or stomp on someones head and be like "I didnt mean for them to get hurt".

Seriously, Im tempted to come take a picture of your bike just to watch you overreact like a buffoon. Funny how all the bikes I have taken pictures of arent sitting in my garage right now, I must be doing it wrong.

Now on a serious note, it does sound odd that someone has taken photos of your bike in such a way. If you feel really worried, report it to the police and they should be able to track the last person that went to the post offic and got your address *if they have done so*.

As I read this I was thinking "Surely not if you're standing on public property". Then you nicely answered that by the rest of your post:

Yes, it would need to be MAJOR shrinkage for it to be a laughing matter. Normal shrinkage doesn't bother me at all.

Apparently, as the stories go, both the same... Both on footpaths, walking by, seeing naked people in thier homes...

But then again, it was on KB... can't believe all you see on here....

Does that mean if I'm skinnydipping at the beach people can come right up to me and take a picture of my penis and my right side?

That's a complicated question because the Crimes Act was updated a few years ago to make an offense out of "Intimate Covert Filming". The updates were made so that the authorities could criminalise things like upskirt photography, or the use of hidden cameras in changing rooms and public toilets.

The updates to the Crimes Act have made it an offense to take photos in a place where the victim is "naked or has the sexual parts of his or her body exposed, partially exposed, or clad solely in undergarments or is engaged in an intimate sexual activity or other personal bodily activity that involves dressing or undressing." However the updates only cover photography in places where there's a reasonable expectation of privacy. Public places like beaches are very much a gray area.

But as I am sure you can understand, a naked motorcycle is not the same thing as a naked person.
