Do I give them the $500 back ? ?
Or do I give them $250 back ? ? $250 to me for them wasting my time..
Or do they get nothing back ? ?
This has happened to me before...And im a little unsure on the Rules or Laws..
Your info will be greatfully recieved..

Keep it - it pisses me off, how do you know if someone after reading your add - then seeing your post that it had sold thought 'dam - missed out on that one', then promptly pressed the buy now button on a more expensive bike on trademe?
Now sitting here reading your post thinking evil thoughts
If they were going to change their minds - they shouldn't of given you a holding deposit
Your bike is cheap

So what purpose does a deposit serve if you just give it back when they change their mind? What if you've turned away other buyers because you thought it was sold?
I say fuck 'em. I'd keep the deposit and drop the price of the bike by the amount of the deposit. :done:
YellowDog
7th May 2009, 16:55
It all depends upon what was agreed. I suspect the deposit was so that the bike would not be sold elsewhere until the potential buyer had the chance to see it and make their mind up.

7th May 2009, 17:01
If someone gives you a "holding" deposit, that means "I AM GOING TO BUY THIS BIKE AND WILL PAY THE REMAINDER LATER". If they default, they lose the deposit. No question.
However, it's your deal, so your choice.
If you lied, that's a different story.

7th May 2009, 19:59
I would say it is alredy sold unless it has been misadvertised.
if you can be fucked you could take the new owner to the disputes for the remaining purchase price.
If you cant then keep the deposit and carry on.
If I didnt have an unhealthy objection to zookis then I would be all over it.
I'd be all over it like a rash for $8K.
If I had any fucking money. (Or any celibate money for that matter):crybaby:

That's a fair price - that's all they're actually worth - it's certainly not cheap.
TradeMe (and the world) is full of unrealistic motherfuckers. Motherfuckers that think their bikes age like wine.
I've got cash burning a hole in my pocket and been trying to buy something but none of them want to make the effort to actually sell them.

It 100% depends how you phrased the receipt or in this case the internet conversation re the holding deposit.
When doing a holdie receipt for a car or a bike selling through the yard its clear cut The receipt says NON refundable deposit.
We do make it conditional to for example inspection or them getting finance but clear cut if they change thir mind there is no refund of deposit.
If your receipt doesnt say that or the bike wasn't as described then youre shit outa luck

Just remember, honesty does pay in the end.
However like Frosty mentioned it's all down the the terms you agreed on.

It has carbon cans too, and a nicer colour - is that a dent on the tank?
You'd think he'd at lest clean it before putting it on trademe?
Kinda makes mine $6.5kish being 3years older and done 15km more....
Maybe I can't even get $8k for it ..
Your bike is cheap for what it is - but in this market a bike is only worth what someone will pay for it

I think you were right to hold the deposit no matter what. You were unable to sell the bike until the purchaser had decided. It should cost him $500 for the privilige of deciding "no" and therefore dicking you around.

So you're selling your bike - but the phone number doesn't work cause you lost the phone, you can't answer any private messages saying I want to buy your bike - cause you're sin binned
No other contact details for you
You say it's on Trademe - yet I have searched under every conceivable search topic and can't find it on there?
Ask you to post a link to the trademe auction - you were on line when I asked, and yet you can't be bothered?
And where have the photos gone?
I think you might be full of shit!

This 2004 Suzuki Hayabusa in near new condition with 22,500kms on it, scotter oiler etc...
Sold for $8500 in July 2009........Within one week of advertising it..
People there is a leason to be learnt here, price your bike right and it will sell..
I would guess this bike is now worth $7500 max if its now done 30,000km
Over price your bike, and two years later it will still be sitting in your FCKIN shed.
