View Full Version : Wrong info recorded on offence ticket plus...
Anyone know the deal if a Cop records the wrong info on a ticket.
Cop asked me for my licence (without telling me why) after stopping me last night. ( Howick - Pakuranga Rd) 9.40 p.m
Wandered around my car for 2 minutes and came back to the window.
I had to ask why I was stopped as he scribbled in a notebook.
Told me I had run 2 red lights. ( absolute Bulls*t) and he had followed me for some distance.
Actually he had turned out of a side road intersection (with flashing lights on) after I passed through a light on the yellow.
Said he had followed me from the Caltex station. (Actually I came from the BP station - receipt to prove it timed 4 minutes before) through 4 sets of lights ( Bull sh*t).
I told him he had the wrong car and he did not follow me from the station because he pulled out from the side rd 2 lights back. He denied it and said there were many cops on the road that night. I asked him where the one I saw in the side rd went because it did not pass us. He did not reply.
Asked to talk to his "mate" who was ignoring the whole scenario. He said he was the driver so not to bother.
Asked me name ., address ( please spell it - I did twice - maori street name in Parnell) etc.
Told me to wait here (5 minutes - in the cold) while he went into his warm car with his "mate". Wrote up a ticket and returned.
Gave me the ticket ($150) and said I could dispute it in writing etc.... I walked off telling him what I thought of my chances after his BS.
Looked at the ticket later. Correct street name but he called it "Avenue" instead of "street". Wrong suburb entirely ( Bucklands Beach) despite what I told him. (Parnell)
Weird thing considering the accusation and time of night... he never even breathalysed me ( I would not have failed).
I have never run into a such a prick before . (young shaven headed cop with attitude to spare). I have a lot of respect for cops and the law and this dude has really wrecked this big time.
Side note: Never checked my car interior even. He would have been surprised what he would have found had he bothered to look. ( I had been at the Howick Rifle Range , AG club evening and had a legitimate high powered airgun , safely cased on the back seat). Wanker needs to better trained before being allowed on an un suspecting public.
Whats my angle on this guys? I absolutely did not run the two reds. Not even close. The 3rd light - was yellow as I got to it and remained so during my transit. That was the intersection he came from despite denying it.
The licence check would have confirmed my correct address as I supplied it. ( Its current and the lifetime(joke) licence was renewed recently ...so I know that as fact).

if so i saw ya get pulled up and it wasnt red when you came through the intersection the piggy pulled out of...
and there were cops EVERYWHERE last night...
saw 4 different people pulled up on the way to and from getting dinner (10km total?)

Write a letter to the PIB (Police Infringement Bureau) and advise them..
- You were not in or near Bucklands beach at the time of the alleged offence
- You were not in xxx avenue at the time of the alleged offence
Include a copy of your receipt for gas, it's impossible to get from Parnell to BB in four minutes. unless some maths guru wants to work the distance over time to get a speed to do so.
They're taking the piss I'd say so take the piss back with the speed required to get to the place of the alleged offence.
End of story.

Perhaps you should have invited him to take a breathalyser test?
So far as getting your street name wrong, that is not an issue however as far as getting the facts of the alledged offence wrong, you can challenge this and win. Don’t give away the fact that he has got it wrong and ask for a copy of his report. If he has got it wrong in his report and you can prove this with your receipt, they should drop the case.

Yeah just go straight in and talk to the station manager. Just tell him "dunno wtf your boys are thinking, but this is completely bogus."
DON'T TELL THEM they wrote any details down wrong. DON'T INFORM THEM of any mistakes they made during the course of writing the ticket out. If they decide to go you for it, you should then wait for the computer printed notice and then deny it in writing.
And for fucks sake, don't stand out in the fucking cold while they make you wait. :weird:
(incidentally, you do not have to wait, you can drive off once they have identified you.)

That sucks..
Only ever got off once from a ticket as he failed to fill the fine amount $$.
Had another young cop give me grief for absolutely doing nothing wrong.
Story:
Dropped the mother and father-in law at their church as the old boy was no longer allowed to drive. Hadn't been drinking that sat nite so thought it wouldn't b an issue and I was already up. On my way home passed a cop car going in the other direction. He spun around and floored it to catch up (me watching the rear view mirror closely) then pulled me over. He got out asked why I had tinted windows?
Reply: They are legal so whats the issue and why have u pulled me up?
Cop: Just doing a general check. (Speak to the analysiser, check warrant and rego and driver details).
Then arsehole try's to go into my past when I was a teenager (more than 20 years ago) fuck he would of been in his nappies. Started to accuse me of all sorts of shit..
Took my seat belt off and ask him if he wanted to discuss it further and if he was going to charge me with anything. He didn't say fuck all except u can go now..
Definitely write in as Mikeey hs stated.
Just remember just cause u get 1 bad one not all of them are power tripping...maybe just a few more..:confused:

Slightly similar thing happened to me a few years back. was testing brakes in customers car on an empty industrial street. was in overalls in someone elses car 100m from my workshop. Cop came around far corner - saw me braking heavily. assumed that I was doing high speed and somehow produced 'evidence' on Hawk that I was doing 92kmh in a 50!
But he got the name of the street wrong. The road changes name at an intersection 500m up the road.
I waited until court day- stood up and said 'at the time of the alleged infringement I was not driving a motor vehicle on ------road'
The cop visibly spewed! - I went on to produce evidence on maps that showed that the point where he stopped me was a different street and that a
Nissan Pulsar wont accelerate that hard anyway...
BUT..... The case was not being heard by the District court judge- is was being heard by a JP- they do not have to make a desision based on the law!!
she decided that the 'evidence' was enough to nail me despite that I was in another street and no way was I doing 92kmh

Years ago, my old man got a ticket and when the cop arrived to serve it (this was back in the late 70's) he asked ''are you bla bla bla''? dad said no....''my name is yada yada yada'' (not his real name) seems the cop had wrote down the right names but in the wrong order, got off the ticket...maybe be different now dunno? I dont get speeding tickets.

Is it true that sometimes some cops try to save the situation (or their face) by giving out tickets with deliberate errors so that if the driver choose to contest it then it would be easily waived?
If it is, then it is understandably easier than saying "uh, you're right. You're not the one I was after. I got it wrong" which fits the 'power' profile.

Amazing! This thread is now Court evidence.
I have always considered Judges and Lawyers to be thoroughly lovely people and I always appreciate what a tough profession they have to contend with.
I would certainly not ever consider them less honourable than prostitutes or drug dealers :)
Where did my thread go regarding wrong info entered on an alleged offence that I absolutely did not commit Thursday night (Howick /Pakuranga Highway).
Skidmark responded that he witnessed the event and provided information that he had no other way of knowing (unless secretly he is the cop involved).
I searched to see if it was shifted!

Appreciate that. Lets hope it doesnt come to that but I will mention I have an unsolicited witness who I do not know and have never met. I wont phone you to maintain the above status...unless this goes further .

wrong info on ur ticket means nothing in terms of getting let off.
you'll have to fight this one in court and you will need a witness.
either way it'll cost you more than $150 is there any demerits with that one?
IF you wanted to get off this ticket and not pay anthing you will have to defend it in court (and you'll need a traffic lawyer) then you'll have to take the police offer who gave you the ticket to the small claims court.
But you probably wont get anything in the court and will have to take the time off work
Might just be best to pay it and remember all the times you haven't been caught <_<

What was the wording on the ticket for the infringement? You can still get nailed for going through lights on the yellow/amber - esp if when he told you ran a red light you tell him "feck off it was yellow when I went through", he's happy because you have admitted that it was yellow. Prob what he was scribbling down - your reply. The wording for the ticket should fairly inform you what the infringement is for, if its running the yellow you could have a problem winning a defended hearing.

Take it to court.
If you are truely innocent get a defended hearing. I recently defended a traffic ticket for following in a distance unable to stop in time or something like that, long story but totally bogus charge, so i denied it and got a defended hearing the courts will supply a duty solicitor and i got the charge dismissed. saved me $150 and 30 demirits

Late 70,s stopped and ticketed for speeding,and having no speedo ,....it was fogged up and in the linen cupboard drying out.. on my bike by cop on bike..... he wrote on the ticket that I was driving a truck...and at a completely different time of day ......waited at court ..cop informs me hes decided to drop charges...
walked off with smug grinn...They need to have there facts right:spanking:

They don't. I have noticed this. I also drive a silver Alfa. Only two speeding tickets I've ever had in my life were in the alfa. Within a year of each other. Both dubious , as in , yes , I was speeding, so I didn't contest them (only 10-20kph over anyway), but, I was doing the same speed as all the rest of the traffic around. Both times the cop singled out the Alfa , pulled it out of the traffic flow. Jealousy, maybe.
Funny thing is the WAY he said to me..."is this your car"
Why he would be incredulous? I am f*kin 56 y.o and cool as ... (IMHO)
You maybe right ... jealous / envious. (Doubt it but who knows)
I believe he got the wrong car.... his incompetence is evident.
