Maidstone Yamaha: A very dodgy bike shop

My Father took his Kawasaki ZL400 to Maidstone Yamaha and asked them to sell it on behalf-of. After months without a sale I went in to the shop interested in buying a used cruiser myself, they never mentioned my father’s bike saying they had nothing in the cruiser line.
I informed my father and he went in to find out why it was not selling and was told it wouldn’t sell that he should try Trade Me.
As he was getting ready to take it away he noticed the clutch cover had a deep gouge in it the left indicator and mirror were smashed off and clutch leaver was bent. He went back into the shop for an explanation and was told whilst moving his bike outside they failed to extend the side stand and dropped the bike. He asked if they would repair the damage and they said they would. A couple of months latter he received a call from the shop saying he needed to pick-up his bike as it was taking up room. The bike had not been repaired they said they wouldn’t fix it.
He now has a bike he can only sell as a wreck as it isn’t warrantable.

    Sounds like something that should be taken to the small claims court. Its about $50 to file explain the story provide pictures of the bike before and after with any other communications you have from the store and chances are you will win the price of repair back.

    I would assume he signed an agreement with the shop for them to sell it on behalf, the bike should have been covered by the shops Insurance while in there , it was not being stored there, but was for sale so their out clause will not apply. Make a claim in the small claims court against the shop and their insurance providers send a letter to the shop and insurance company stating what you intend to proceed with civil action unless the matter is resolved forth with.

    Sorry but this does not sound like Mac. Best thing to do is stop the bull shit on here and go see the man yourself with your concerns and you might find the out come isn't that bad.
