The rule didn't apply then. This is one of a series of new rules most of which are designed to lower the cost of competing in MotoGP. Less practice, less testing, and restrictions on the number of bikes per team.
According to the latest BIKE mag out here, a number of the GP riders have expressed disatisfaction with the new rules. Rossi is looking for a challenge after 2010 and a member of Rossi's pit crew has apparently stated words to the effect that they'd get half the money but double the enjoyment in WSBK.
Stoner has apparently already hinted that he would be just as happy piloting a WSBK Duc as a MotoGP bike.
