    Angry Help with boss

Hi guys, My boss has blamed (IMO good results) bad stocktake results on me. (the warehouse guy). I asked if there was any chance of processing error or item checking apon returns (they have dozens of returns everyday that are often baged wrong by the customer)

the boss said no. I have done stocktakes here in the past and even with bad results the boss kept high spirits and said for me not to worry there was many reasons why stocktake results could be off.

also she mentioned that it was suspicious that some items were missing from shipment models that had no orders yet.

should i just get on with it and forget?
if they try to blame me can they prove it?

many people often come to warehouse while im here and tamper with items/shelfs so its not just me here.

    cheers

I do advocacy on this frequently.

    There is a process.

First they have to advise you of what the issue is and make accusations to you. They will tell you (prob in a letter) that it is serious and that you job may be terminated as a result.

Then they must complete a FULL and FAIR investigation.

Part of this will be a meeting with you and a support person.

They have to listen to you and be without prejudfing the outcome.

They then look at all the evidence and make a call on what to do.

Since there is no letter - or accusation at this point - just be helpful but dont say anything stupid. And make sure that you dont get in a position where you are anything other than whiter than white.

    Good luck.

oops - BTW they do have to prove that their suspisions are correct to a level that a 'fair and reasonable employer' would believe that you are stealing.

They do not need to prove it to a level of criminal conduct.

look at the Department of labour website - there is a ton of info.

if you are young - see youth law.

And remember, its practically impossible to fire someone who is, or even isnt doing the right thing these days. Too much risk of a lawsuit, so maybe they are trying to scare you into quitting instead?

Its not a law suit generally things are raised via a Personal grevance and settled in mediation or the era - very few make it to the employment court (which is extremely expensive).

and actually its not that hard to fire someone - you just have top be fair and reasonable.

    What Tank said.

Failure to follow the process causes the employer much grief.
There are many things that reduce the accuracy of a stocktake. SOme of which are policy driven by your boss.

I was once accused for stealing the bar till at a jazz club I was working in Berlin!....ha ha! And then the place got robbed and the boss accused me of that too!!!...it was a very 'black sheep moment' for me. I told him to shove it and walk out right there and then...

Not a nice feeling at all, being unjustly accused of stealing! I just saw it as being time to move on.

I think you need to ask yourself whether you're happy in your job or would you rather work somewhere else?...

If you're happy, just relax and do your job well. It will sort itself out.
If you're not happy, then start putting your feelers out for a new job. Maybe think deeply about what you wanna do and where you wanna be...it will present it self in time dude.

Either way, I wouldn't be having any grand discussions with the employer about your plans. You don't really want to draw attention to yourself, as it seems obvious that your boss is really just in a state of 'hating at someone...anyone!!'

Just stay relaxed. And rise above it - don't let it get on top of you.

    PS...dude, it's xmas...people go crazy...

Document all interactions of any accusatory manner or any hostility with date and time. Then quit and file a grievance for "constructive dismissal"

If there are other people with access to the warehouse, bad coding or whatever what I would do is make a list of areas that you see the potential for error or theft. List them down with possible ways to reduce the above or tighten up the whole system. Present them with your report and leave it in their hands.

You will be seen as proactive and you cannot be held liable if they don't act on what you see as their shortfalls.

Sounds like your stores are as good as ours - people in and out and no real record kept of what they are taking. End result 1000 units in and 950 sold - where did the rest 'go'?

Point out the flaws of the system in your nicest manner and even make suggestions on how it may be tightened up.

In reality if you are to be held solely responsible for the stores you need a system implemented that locks the whole stores down so in and out goods access is severely restricted and recorded. She'll hate it!
