We can't see whether it has a mag in it. That dude might have safed it (you know, pulled the mag, checked the chamber, put it down, sniffed some Contac, had his pic taken, sniffed some Contac, gone on a killing rampage (with a machete, like Antonie Dixon)

Since it is not an issue firearm then it is possibly part of the illegal drugs haul.

It's possible that the gun was checked and shown to be unloaded.Plus even if it wasn't,they very rarely discharge spontaneously when lying untouched.:slap:
