Angry Ticket for 55 in 50 area that turns up 2 months after the alleged infringement

Got a speeding ticket sent to me that turned up today. It is for one of my cars.

It is for a allegded 55k in a 50k area. It supposedly happened 24 Feb 2010. It is a reminder notice (the pink slip), but I have not had the original one sent to me. Or at least it has never turned up!

OK, so it is only for $30 and most would just pay it and carry on with life. (And this is one of the reasons I smell a dead fish...)

But this really pee's me off. On a few levels:
    1. It is 10% outside the speed limit. I did not think they worried re this?
    2. It is on a very busy occasionally 4 lane (2 each way) road where the speed is never kept at 50k or under.
    3. Only the street and the suburb is mentioned. Not where (could be anywhere inside a couple of K's)
    4. I never recieved the initial one. And not much post goes missing here.
    5. I can live with the speed camera ones. I always get a photo sent to me so i know it actually happened. But this one? To get a ticket 2 months later saying "You did 5k over the limit 2 months ago, I did see ya..." does not sound right.

I will contest this and see what comes out of it. Will write a letter later this w/e and send it to them.

    Comments?

May the bridges I burn light the way.

    55?
Were you within 250 metres of a school between 8 am and 4.30?

Apperently 7.49 am on Wednesday 24 February on Gloucester Street Greenmeadows. And as I have no idea where on the road it is taken I have no idea if there was a school.

Gloucester St runs from Taradale shopping centre to York Ave/Guppy Rd, where the New World supermarket is.
Greenmeadows primary school is on Gloucester St, but i thought that the school thing started at 8 am...I could be wrong though

We had a note left in our mailbox one day a while back from a towie who had come to collect our car for an unpaid fine. Called the courts and it related to a $12 parking ticket we had (never) received 2 years earlier. It had escalated to quite a fine two years later with fees on top. Anyway, we could prove we never received the original fine as they had our old address (we had to show the S&P Agreement for our current house) they cleared it all up and reissued the ticket for $12. Thankfully the car wasn't in the driveway when they came for it!

So, how did the towie know where you lived if the police did not?

The baliff has better reasons (incentive) to find you.

We did ask and we were told the courts have acces to a "different database".

New Law just passing soon , you would have found your license suspended also! For unpaid Fines. Should be a Laugh to start with, as they (Justice Department) make a few of mistakes.

I'd be querying it by just saying you disagree. Speed cameras are one thing, photographic evidence and all that, but if the cop isn't going to pull you over and issue a ticket there and then it all sounds a bit suss. What if they got one digit/numeral wrong on the number plate and it went to the wrong person ? How did they record the number plate and speed at the same time ? Too many questions. I'd just say that I don't drive along that road regularly so don't believe it was me and see what they come back with.

As for the speed, well, even though they publicised the drop to a 5km/h tolerance outside schools they can still ping you for that anywhere they want if they feel like it. It is still exceeding the speed limit.

You sure it's not a speed camera ticket?

From memory if it was an actual traffic cop who saw and clocked your speed and didn't pull you over at the time, they would have to identify the driver via a letter first and then only issue the ticket once the owner identified who was driving the car. Not usually done for speeding tickets in general, let alone ones at that speed.

Ticket would seem pretty suss on a few levels.

Well, thats real bright and Im sure they will until next time when they come back with a fines warrant to seize property.

Write back ASAP, explain your story, and ask for notice to be withdrawn.
