How pissed do you have to be to fail a breath test?

This morning me and a mate got stopped by a cop. I was the supervisor seeing that he has a restricted licence. I was pretty drunk at the time, and I definately should not have been driving in that state (I wasn't driving at the time). However, when the cop breath tested me it came back as 'fail youth', which means I was still under the legal adult limit. So how pissed do you really have to be to fail an adult breath test?

Interesting chart on the South Australian site.

As little as three standard drinks in an hour could put you at 0.09, which exceeds our current limit of .08.

And three standard drinks is only two steinlagers/stellas/heinekens.

It varies for each person.

A supervisor of a learner or restricted driver has to be under the limit as they have to be "in control" of the vehicle.

Most smaller builds will fail youth on one pint.

I was watching motorway patrol once when a cop pulled over a young chick on her learners or restricted. Her boyfriend was absolutely pissed..passed out in the front seat. She was allowed to drive off.

I'm skinny as fuck, and I was drinking at least 12 standard drinks in the 4 hours before the 'incident'. I've never seen any law which states the supervisor has to be sober. The cop even told me he couldn't do anything to me if I did blow over the limit. As for being in control of the vehicle, if the driver loses control at 100kmh there is very little I can do from the passengers seat, regardless of how sober I am.

That has changed now, as of the 1st December 2009. Before then, that was all one could do. Give them a ticket and send them on the way, for exactly the same thing they were just ticketed for....

Different now. Can take the keys, park it up and everyone walks, until a sober fully licensed driver turns up...

The driver would / could be done for driving while unsupervised, as the supervisor shouldn't be pissed.

The supervisor is supposed to give advice and guidance, so one doesn't "lose control" at 100kmph.....

How pissed you feel and how pissed you measure up are very different things.

Back in the day when I indulged in this evil stuff, I have woken up in the morning feeling perfectly sober (albeit hung over as fuck) and blown well over the limit.

Conversely I have had one drink that made my head go "FONG!" and been well under the limit.

How pissed you feel is not to be trusted...

If you had 12 drinks in 4 hours and you are skinny, then I am quite surprised you didn't blow past the adult limit.

It just goes to show how fucked up our drink driving laws are. [soap box on]NZ should have a zero limit / tolerance on all classes[soap box off]

Years ago after footy training I had 2 stubbies then, on the way home I got stopped at a checkpoint and failed the sniffer thing, but passed the blow in the bag part. The cop asked me how much I had and he said that I should never drink more than that if I was going to drive because everyone is different.

I was definitely not skinny 6'1/110kgs. From that moment on 2 stubbies is the most I will ever have if driving.

The device that the popo peeps use take a reading is of mouth alcohol only.

If you have just finished having a swig , or conversly washed your mouth out with water the reading could be out. Peeps have failed after swigging mouthwash at home then been tested at the station and blew zip.

That is why they are not evidential. Those ones the air is from the lungs.

I don't know what those machines that you can buy to test yourself are like but I would be gutted if I used one that said sweet to drive, then get stopped and fail an evidential breath test.

Apparently they're pretty accurate if you get them re calibrated according to what the manufacturer recommends.
