If a Government Agency and Government actors use a 3rd party to abridge the freedom of speech and the freedom of the Press (The NY Post would be considered part of 'the press') - is that in the spirit of the First Amendment?
And before you go 'Huuuurrrr Durr they haven't made a law, so doesn't count' - let's look at the precedent set by Marsh vs Alabama - Congress passed no law in that case either, but the Supreme Court held that (And I quote):

So, we have a long and well established legal principle here that the 1st Amendment applies (in certain instances) to privately owned institutions (Not just the Government institutions) and it does not require any law passed for a violation to occur.
Therefore getting a private company to do the governments dirty work is entirely against the principles of the 1st Amendment.

Back to the matter at hand, considering his use of the word 'Violation' which is a pretty strong and definitive word - when taken together, it's pretty clear that the rep thinks that what is going on is egregious enough that it could be an outright breach of the 1A. Even if it is not a technical breach (that is sufficient for a SCOTUS ruling, that it's close enough to the line to be improper - and it's that last bit that is key.
Even if it's not an actual breach, it's close enough to the line to be an issue - the Democrat rep knew this and so did everyone else.

Well it seems high capacity fast charging is feasible but with high voltage battery packs. The numbers are crazy though, I don’t think truck drivers should be trusted with this kinda electricity. It’s got back to the future clock tower written all over it
