    Thumbs down Cellphone question. Help

    I recently brought a Samsung Glaxey S I have had it for three weeks got it from Noel Leming at Lynn Mall.My phone keeps on turning it self off and not turning on when I try to do it so far this has happened 5 times.When I got the I took out a extra 5 year warrentee also I have a one year warrentee with the shop.So I took the phone back to the shop today in the box with my reciept everything still actually have the shop bag the ph came in.So I explained to the man what was happening to the ph and he went that shouldn't happen I said i'd like it replaced.Then he told me I have to pay $55 for the phone to get sent away to a technition to have a look at and get fixed I said I need a phone over christmas cant you just exchange it for another he replied no again you have to send it away to get fixed and pay the money we will re in burse you the money when it comes back from the shop when it gets fixed but I cant tell you how long it will take to get fixed.

    So it got even better I saw the guy walking in the back who sold me the phone so I waited for him to come out and had a little chat to him trying to keep calm...grgrgrgrgr I stood there and went throught exactly the same thing he said exactly the same thing but then he told me before the phone can get exchanged it has to break down 4 times and get sent away to be fixed then it will get replaced.So I was sort of getting slightly a bit even more well not happy so I said I thought these were meant to be a good phone and I spent $470 on the phone and it shouldn't break down to start off with its only been three weeks since I got it never dropped it I got a silicon cover for it not long after 3 days it has a cover on the front so it wont get scratched.

    So like I am standing there and it turns itself off full battery too I turn it back on then it turns it self off again the shop man is going oh I see what you are saying thats no good that shouldn't be happening.

    So its become sooooooooooooooooooooooooooooooooo fustrating I spend all that money on a phone and its not working
    what can I do about it aprantly none of my extended warrent means anything

    Have you tried a firmware update? or reset the phone back to factory settings

    i would go back monday and tell him you have had some legal advice over the weekend through family or whatever and you think he is in breach of the fair trading act and the consumer guarentee act or similar as in the goods he sold you have to be in good working condition and fit for purpose, which they clearly aren't,and this is last chance for them to put the situation right before you go to a higher authority.............smoke and mirrors...........good luck
    or you could go back to the shop,purchase a better more expensive phone paying by cheque,walk to the bank and cancel said cheque,walk back to the phone shop and give em back the samdung

    Definitely send it back. As well as turning itself off it looks like the spell check isn't working.

    Ok a quick look at the Samsung web site suggests ring them direct on Monday

    Part way down the page there is an 0800 number.

    I suggest updating to the latest version of Gingerbread from the Samsung website, if you go the official route then you don't need to root the phone and you keep the warranty.

    It sounds like it's probably a software rather than a hardware issue. A mate of mine has a Galaxy S and he's had a lot of problems with his so he kept updating it till he found a stable release for his phone.

    You could always root it (I've heard z4root is good) then chuck on a Cyanogenmod with the latest release of GB.

    Thanks for that information i'll do it straight away next Monday and hopefully I can sort things out.

    Extended warranties are where the sales guy makes his money... In most instances the Consumer Guarantees Act gives similar protection.

    I recently purchased a new Motorola phone which stopped working on day two. I returned it to Telecom, who sent it off free of charge to have technician assessment, repaired (or replaced), but provided me with a loan phone for the period it was away. It turned out to be a fault with phone, and new phone supplied without question.

    Moral of the story: Don't buy from Noel Leeming...

    Hope you get it sorted Ladydragon - NL ought to know better than that. I'd be yelling at them by now and threatening legal action as well.

    Don't you worry I did do that I was getting sooo well angry at the guy and had to control swearing at him and not the nice word either it would of started with''F'' the bizare thing was when I spoke to the guy behind the counter he thought I was just going to forget about it but then when I saw the guy who actually sold me the phone and waited till he came from out of the back I did corner him and didn't let him move and also I couldn't help myself I said to him this is just totally ''FKN'' me off about this phone I just could help saying it.

    Perhapes I need to go and say a few harsh words I did control myself but what I did want to say didn't happen I actually don't know if swearing helps sometimes.

    I've actually just logged on and had a look at their site and had a good read of everything Noel Leeming done their job properly sold me a phone that works properly so I think the conumer guarentee act would be the best way to go about it.
    Its just soo fustrating I thought it was meant to be a really good quality phone

    The $55 charge to look at it, which is then reimbursed if a fault is found, is reasonably normal.

    After all, they don't know yet if it's something you did that made it that way. (Obviously you know better, but they don't/can't).

    When I bought my last phone (from a very different store, that had the same policy) I queried this.

    The guy told me they get heaps of phones back for "repair" that are (just one example) simply "full" because the owners never delete old text messages. That kind of stuff.

    Obviously not what's happening in your case, but they need to have standard policies.

    Since you could demonstrate in the shop that it shuts itself down, clearly it's got an issue. But it's normal for them to want to try to fix it before doing a swap.
