As soon as the cops have taken your statement, call his insurance company and make a claim against it for your cars damage.

Don't wait for the cops to assign blame since they probably wont put anything conclusive in writing anyway.

Just come back from cop shop. Other driver was in there at 8.00am (when they open) making a statement. It turns out the guy that lives nearby and denied to my partner he saw anything now is a witness for the other driver and gave him his card and said he was prepared to stand up in court and say what he saw. This just get dodgier by the minute! Now we wonder why he didn't call the police when asked?

On a good note, at least it is now being investigated by the police and we have been advised they will be in touch. Will be able to give them the photos of the bald tyres, advise the fact the warrant expired on the day and the skid marks will get measured. Have also advised that the other driver wanted my partner to claim that it was his girlfriend driving at the time of the accident.

    Merry f**ken xmas!

My partner was driving to work (car) the other morning and stopped at an unmarked T intersection waiting to turn right. He gave way to 2 cars coming from his right and there was another car coming from his left that he could safely pull out in front of as it was a good distance away. As he went to start to pull out, a car came flying over the brow of the hill to his right. My partner stopped about 2-3 feet out of the intersection. The car slammed on its brakes and clipped the nose of my partners vehicle. We will measure the skid marks today - they are good ones! The other driver could have safely crossed the white line to avoid my partners car but did not.

My question is - Who would you say is at fault?
With another car coming from the left , the car coming from the right would not want to cross the centerline (at speed). And your partner was parked in the middle of the road for 3-4 seconds (before impact) ... ??? Why did he stop in the first place ... ??? he had time to get out of the way ...
