    Crashed!

Was lanesplitting along the North Western this morning being followed by another biker and a guy decided to change lanes just as I was starting to pass him on my right. I don't quite understand how but the right hand side of my bike went down and broke off the front brake lever and footpeg as well as braking the casing on the gauges and pushing the whole display out of alignment (all that I can see). He pulled over, admitted fault and I got his details. He said he would pay for repairs.

What I want to know is since I was lanesplitting will my insurance company stand by me getting my bike fixed or should I get a quote to fix and give this to him?

Also, help to get the bike from University of Auckland to Swanson would be much appreciated as I don't want to ride it in the current condition

Yeah I know and I feel stupid for it, but physically fine.

Would really appreciate if anyone knows how insurance companies look at lanesplitting? Would I be covered or in the shit because I was not in a lane?

Not in a lane? Where, exactly, were you then?
Do you realise how many holes there could be if people would just take the time to take the dirt out of them?

There's a wiki somewhere covering lanesplitting legality. As long as you weren't doing anything illegal then the insurance company has to cough up.

Hey, sorry if I came across as nasty wasn't what I was trying to do. But you'd be best to learn a lesson here...

As for insurance, is the damage worth more than your excess? Is it even worth claiming for?

No, you didn't seem nasty at all, completely agree with what you are saying. My excess is $300 but will need new gauges as well as lever and footpeg and something is rubbing. But I should not have to pay excess since the guy fully admitted his fault and seems like he will genuinely pay (although I know I have no confirmation and was silly enough to only get a couple of phone numbers again). But if my insurance will not follow through with getting the money from him cause of my lanesplitting then I will just get an repair quote from cyclespot and give him the bill directly

Yeah but I have no idea what lane I was in before he started to move, only after

It doesn't matter what lane you were in. But it DOES MATTER WHERE in the lane.
If you're gonna split, you need to abide by the rules and know exactly what you are doing.
Sounds to me like you just go ahead and trust that all will be well?

If I was in the righthand lane I was undertaking him, if I was in the lefthand lane I was overtaking him in this context. But I can not at all remember. Hoping my witness maybe will know

''a guy decided to change lanes just as I was starting to pass him on my right''

I can tell you, that you were probably in the left lane (or the middle lane if there were three) ..either way, the vehicle that you collided with didn't know you were there.
It is also possible that you were in his lane but pssing him on his left (for this scenario to occure)
An insurance should cover that...it was an accident...you were in a lane (unless you are really clever/dumb and can ride on the white lines/cats eyes?) at the time and another vehicle decided to change lanes..

The witness confirmed that I was on the left of the centre line so I am definitely contacting my insurance

Claim on your insuramce and let them chase the other fella for money. That way you get your bike fixed and you dont have to stress. Tell it how you remember it and be much more aware in future.
