    Even if you had pulled out, and was overtaking, and then they started slowing down to turn right (and there speed drop must have been noticable), you could have braked and pulled back in behind them.

    If you were so close to them at the point they pulled out that there was no chance of braking then I'm on your side. But even so, it's not usually worth defending. Paying the fine is so much easier.

    Something doesn't sound right.
    The place where the alleged offence happened must be easy to identify as we are told there is a rest area on right. I would presume that rest areas are only put in where there is plenty of visibility, especially one where traffic can turn right to enter them. I would have though the offence would have been overtaking on the right a vehicle that was turning right. Or was it that the OP hit an on coming vehicle, the key part of the offence being that the road was not clear rather than them not have 100m visibility?
    How did the get involved? Were they on site or is it a crash or a complaint? If it is a crash then it could be much more than just paying the fine if the real cause was no indication.

    I went to overtake a very slow moving car who decided it would be a marvelous idea to pull into the carpark on

    the right at the exact time that I was going to pass. Now here's the thing if the car I was going to overtake had

    their indicator on I wouldn't have passed (that would be stupid right?!)

    and illegal. Instead the car operators failure to check for overtaking vehicles and turning without indicating was illegal.

    Sorry, but I find it annoying the number of people who forget it is their responsibility to check they themselves are not being passed before they pull out to pass, a bit of a hobby horse but

    If there's a side road or anywhere they could pull in to you shouldn't pass.

    Without video evidence, how do you prove the car didn't indicate?

    Human nature means the driver may well (honestly in their view (because memory is not perfect)) swear in court that they did indicate.

    I doubt a court would side with the bike.

    Bullshit. There have been plenty of threads on this, commented on by people in the insurance industry and those that have check with their insurances as a result of the ACC hike. Insurance view rego as the tax it is and nothing to do with vehicle operational fitness.

    Also no video to prove the OP wrong so doubt therefore OP gets the benefit. As said earlier the offence appears incorrect which in turn suggests the blame is being pushed in the wrong direction and that could affect your ACC levies

    I would fight it,

    As i see it, you have nothing to loose. Also it takes five minutes to write a letter. You cant win without a ticket and at least you tried.

    If your recollection is correct, the car is in the wrong. It is not illegal to overtake a car if there is a rest area on the right. You are to indicate for at least three seconds before changing lanes or executing a turn. Simple.

    If however, you are full of shit and just weren't paying attention and/or you passed on yellow lines...... you are buggered.
