    Roundabout accident

    Hey Guys,
Just wanting your opinion on an incident had tonight.
I was driving down a road, coming up to a roundabout, with my lights on and everything.
Just as I get to the roundabout car pulls out very fast from my right (so I'm supposed to give way)
I'm not too sure whether she saw me coming because she slowed right down as we nearly hit each other.
SO I as soon as I saw her pull out to the roundabout I slowed down - Brakes on, as this happened I slipped off my Vespa, and causing damage to my bike as well as my phone in my pocket. She then got out (her car was in front of my stopping lane for the roundabout) and asked if I was alright. I didn't say anything - pissed at her but gave her the thumbs up as I picked up my scooter to make way for the traffic coming behind me. She took off not giving me any details. A witness noted down her plate number so I have that.

I know I am supposed to give way to the right, but it didn't seem like she looked before she took off.

Am I completely in the wrong or is she to blame as well, I want to contact the police.

    I am not insured.

Let me know what you guys think.

    Cheers

Then you already know the answer to your question. Sorry to be harsh, but imo, ride defensively or not at all.

To be fair I didn't really have enough time to give way- by the time I saw her pulling out I slammed the brakes...
but thank you for your opinion.

You only didn't have enough time because you weren't riding defensively...

    Certainly.

Get off the road until you learn basic road rules. And get some insurance.

Sorry dude, you're in the wrong. You have to give way to people approaching from your right. No ifs, ands or buts. As said, give way means be ready to give way to traffic, not travel so fast that you can't. I'm sure the cops would tell you the same. At least 3rd party insurance would be a good idea but obviously not mandatory in NZ

So you came up to the round about without being able to stop safely if you had to give way?

Always approach round abouts expecting that someone is going to blow through it at 50kmh because quite often people do (pet hate).

Never asume any other road user will see you.....you failed to stop safely which is careless driving/riding on your behalf and is a traffic offense...

Lucky for you in this case its just things that were damaged,

Take advice and learn the road rules and how to stay safe on the road, get insurance it will save alot of dramas later on.......

So it sounds like she had right of way, but slowed because she thought you weren't going to stop in time, you hit the brakes and binned it all by yourself.

At least she had the human decency to stop and check if you were ok, even though she had no legal obligation to do so, most people wouldn't.

To be fair ... at roundabouts you give way to the right. Stop before you enter the roundabout if you have to. You know you have to give way ... so treat the entrance of the roundabout as if a usual give way situation is in place. Slow down and be prepared to stop.

Go to the Police if you want ... but they can take "Failing to give way" seriously ...

    Just out of curiosity
what would you tell the cops..?
    I mean.....
what do you think this lady did wrong?

any other road rules you don't know about ?
Or know about but choose to ignore?

    Forget about 3rd party......
You mind I take out a life insurance policy on you...?
    sounds like a safe bet.....
