    Two legal questions

    Hey Guys,
    Just got my learners license and got a 50CC scooter - I know, I know, scooterfag! I will eventually upgrade to a motorbike.
    Anyway, my questions are:
    - Can we go in the bicycle lane along Tamaki Drive in Auckland, I have been going in it and every scooter I see in it goes on it, but no one seems to know if it's legal?

    - My scooter is 50CC, but derestricted and verrrrry fast, goes 80 with ease. Would I be okay taking this across the harbor bridge? What would happen if I got pulled over? I'd have a motorbike license but scooter would be registered as Moped not motorbike

    It is a scooter. NOT a BICYCLE.

    MOTOR vehicles are not allowed in the BICYCLE lanes. As per the Road Code. (try reading it. all sorts of useful shit is in there)

    I think you'll be safe with your learner motorcycle licence. But you could go to the nearest LTSA testing station and sit your Moped riders licence. Be warned ... it may be a long wait untill there is a vacancy for the practical test. (Licence popularity)

    As for the bridge ... I believe the speed limit on the bridge is 80 km's (I stand to be corrected on that) ... so you'll be sweet.

    There are no issues with riding the scooter on your learners licence, however I believe you could get pinged for incorrect registration class on the scooter..

    I don't believe it is legal to use any vehicle registered as a moped on a motorway. As far as I know, the Ak harbour bridge is part of our motorway system, but in later years it has had an 80kph speed limit imposed on it for safety reasons. (often ignored, but quite sensible I think.)

    My second bike is a 150cc scooter. Previously scooter was a moped. Part of the reason for the upgrade was the Ak harbour bridge. Even trucks now think I am too slow at 90kph & overtake me on it. I prefer to cross on my big bike frankly. They know that is no moped & show a bit of respect!

    If you have a 50cc scooter which can sustain 80kph up the harbour bridge either direction could I please have a look at it? I have never seen any moped capable of this performance & would be seriously interested. (Great way to beat our rego woes!) Is it super charged or something? With that sort of performance it would not be legal unless you weigh in around 30kgs.

    My last point is to ask in view of the above whether you really want to use a moped over the harbour bridge? I guess I would ride it over if you paid me enough, but not on a regular basis.

    As said, it's a moped, not a bicycle. Therefore, you may not use bicycle lanes.

    Because it's registered as a moped, no, you not allowed to use on the motorway network as it is not capable of exceeding 50kph (mopeds may not exceed a power output (2kw I think) or speed (50kph).

    The fact you've de-restricted it is also illegal.

    I think I am slightly bitter here. I have had a full motorcycle licence & used it for over 50 years.
    I don' t actually like cages much, so I bought a 50cc scooter to use around town a few years ago. In the end I sold it because I thought it could not keep up with the other traffic & was not very safe.

    I restored an insurance writeoff Piaggio Fly 150cc scooter to get around town. It keeps up with the traffic & is safer transport in my opinion. (Nobody would call it fast!) The government rewarded my safety drive by raising my rego fees from about $180 per year to about $414 per year & now requires me to get a WOF for "the hack".

    Still - what's new!

    They may be putting a tolled cycleway over the bridge.

    Then you will have the worst of both worlds.

    A bike too small to ridden with the traffic, too big to ridden with the push bikes, and illegal as its derestricted.

    Perfect really.
