Awatere Huata was convicted in Auckland District Court last week of defrauding the Pipi Foundation, and was remanded in custody awaiting sentence next month. The Serious Fraud Office is seeking a sentence of at least two years' jail.
Awatere Huata had done what hundreds of thousands of white people had got away with, said Harawira.
Harawira, a friend of Awatere Huata for 30 years, compared her situation to that of millionaire property developer David Henderson, convicted for trying to buy cocaine and who was not jailed or fined after he donated $10,000 to a drug rehabilitation programme. (This is because of the laws regarding this - he admitted the offence but the maximum fine was only a few hundred dollars - the sentence for fraud is jail!)
Asked why Awatere Huata seemed certain to be facing jail, Harawira said it was because New Zealand had a racist justice system.
"Maori people up and down the country are not surprised by what's happened because it happens to them all the time. How many corporate guys go to jail? This is her first time (offending) and she's going to jail."
Sharples said he agreed racism was a factor behind the court's treatment of Awatere Huata.
"If this was a middle-class person from Remuera, there's no question they'd be dealt with so harshly."
Sharples said the length of sentence expected was disgusting and he was shattered by it.
"There are many cases where people have been treated lightly for fraud or have got off with no punishment," Sharples said.
"There's an element of racism in it and I'm going to be vocal about it." (So because others got treated differently, she should be too - isn't THAT racist?)
Many Maori were angered by Awatere Huata's conviction, Sharples said.
"There will be protests, big time, from Maori and I will lead the charge."
Sharples said he wanted to visit Awatere Huata in prison this week, and hoped he could help present mitigating factors to the court at her sentencing.
Harawira said Awatere Huata should get a light smack on the hand, not jail, and called for a review of the justice system and its treatment of Maori defendants.
"There are too many Maori in jail and they can't all be criminals." (Agh, she deserved a smack on the hand for stealing $80,000? No wonder so many Maori in jail believe they shouldn't be there if this is their attitude - "oh bro, I didn't mean to steal all your stuff, just give me a telling off and I won't do it again!")
Awatere Huata was a good leader and mother and was totally honest, Harawira said.
"She ain't Jesus by any stretch of the imagination, but she is committed to her values." (Wrong sex for a start...)
Awatere Huata's lawyers had sought bail so she could settle family and business matters before being jailed, and said there was no risk that she would flee, but Judge Roderick Joyce refused bail.
Harawira said it was unfair to Awatere Huata's four children to not let her say goodbye to them before being jailed.
Sharples agreed she should have been bailed.
"It's absolutely disgraceful."
