The article sounds like a classic problem where the employer hasn't painted a proper picture of what is expected from their workers as the minimum in terms of workload.
Perhaps theres more to the story than what was printed.
But if you have a fatty that is not performing all you'd have to do is reduce their hours to part time and say you are concerned for their welfare/health, don't want them having heart attack on the job. Send them to doctor and make them prove how sick/disabled they are or aren't and then restructure them into a more (or less!) suitable job. And include in the contract that employees are required to remain fit and healthy for their respective jobs.
Most of these employment law cases you read about seem to stem from a lack of communication and poor direction from employers about what is required.

It's a shame that anything consumed in moderation that,in itself, isn't bad for you (ciggies excluded) is ripe for over indulgence by some then everyone ends up paying the price. Having said that a person who is a "fatty" isn't necessarily a huge consumer of food or sugar or booze or whatever. Ends up being tricky though making the call as to what's a personal overindulgence (the person who pigs out on junk food and sugar loaded drinks) and what is now being classed as "addiction", "hormone imbalance", or any other fancy pseudo medical name.
