    We all know that there is a massive difference between getting a judgment and getting the money, right?

    This is why I say to the customers "Sensible people do not go to Court".

    By way of example I had this very conversation last week with a very disgruntled customer. Should be easy: construction contract (he's the builder) his client owes him ~$100k or so, and we think has run out of money or decided that contracts dont apply to him. So we have filed proceedings, he is denying, delaying and obfuscating. We are out of summary judgment now and into defended hearing. When we win (and our barrister assures me we will) we still have to get the money off this cunt.

    I have my doubts.

    I'm assuming you've found where he parks his vehicles and if he owns any property ?

    Yep. but imagine I have a family trust and I am a trustee. I get a judgment against me. Oh noes. Quelle Horreur!

    So I resign as a trustee (taking my name off any trust asset), and wear the judgment personally. I can't pay (cue Bohemian Rhapsody: He's just a poor boy from a poor family) and so he goes bankrupt. We are out the money and his lifestyle changes not one iota.

    Oh, and we've spent $20k getting the judgment and trying to enforce it. this prick CONTROLS a lot of stuff but OWNS very little. Unfortunate lack of due diligence on our clients part entering the contract (I didnt act for them then).

    Any Property will be in a family trust and the car will be owned by his business

    You only have to burn the car and they'll borrow money on the property to clear the debt!

    Could do it the other way round, but the car's probably not worth as much as the property.
