    Firstly, there is no such thing as a "pre-existing condition" in a motor vehicle policy, secondly there is no exclusion for a claim caused by a mechanical fault of this nature, thirdly, if the bike was stationary it is the other drivers responsibility to be able to stop in "half the clear distance".

    However don't let that stop you from proffering opinions on stuff you obviously know little or nothing about (it is KBer after all).

    Black Labs can be snappy and bad tempered but they are honest, effective dogs. It must have been a Chocolate Lab, consistently stupid. The only dog I can think of which would hit a bike and a tree chasing a cat.

    Sorry didn't pick up on this can you advise where this comment is posted and what it actually said??

    Was it this "The guy was obviously just creeping along and not paying attention." which doesn't relate to this incident and doesn't mention cellphone

    Agree with you though that its the cars fault as they should have been able to stop within viewing distance
