Calling all bush lawyers (and real ones too)....

    https://www.stuff.co.nz/dominion-pos...ae-after-crash

Now how the hell could anyone have any legal avenue to sue someone based on leaving an object on the grass by kerb?
How is it different to having your parked vehicle hit by someone.

A property I previously lived at had cars crash onto front lawn several times. I often thought if I owned it I'd have a very heavy engineering front fence solution of some kind.....
Yet wire rope barriers are still legal....

pretty sure you're not allowed to park on the grass in town.

you forget, legislation doesn't have to make sense, it just has to make lawyers rich.

i imagine the police (the only one's who'd realy take it to court) would put their hands behind their back and whistle, unless pressure came from on high.
and in that instance, i imagine it would be argued out of court. win-win for the lawyers.

If the guy wants to set up concrete barriers to protect his property and family, more power to him. But he doesn't have the right to put these barriers on public land - he'll have to give up some of his own property to do it.

dunno where that ended up. heard tell some councils were calling it theirs, but you were responsible for mowing it. couldn't plant veges or flowers or nothing.
there was also something about land bounding the kings highways...

anyway. not even sure why these lawyerwanks felt the need to wade in.

People are now defending idiot drivers and speeders? wtf?

That part where they said about racetrack and risk/ responsibility of tyre hitting someone... Well obviously speeding on racetrack is permissible and legal whereas street is not. What kind of cassina-mindedness is this?

I drive around that road regularly, where the concrete blocks are. The only way you can possibly lose control on that corner is if you are doing at least double the speed limit. I would imagine most judges would laugh a suit out of court, commenting that you can't sue someone for damages caused while you are in the course of breaking the law. In the latest case, where the Integra was smashed up, the home owners young children were playing in the front yard when the car hit the barriers; were the barriers not there the children would likely have been killed.

What an idiotic idea suing for fucking your own property up while you were being a dickhead. Crazy thing is, some fucking idiot will probably get a tonne of money out of it. Karma will sort those fuckwits out. You can't drive like a dickhead forever.
And I to my motorcycle parked like the soul of the junkyard. Restored, a bicycle fleshed with power, and tore off. Up Highway 106 continually drunk on the wind in my mouth. Wringing the handlebar for speed, wild to be wreckage forever.

i used to read the court notices whenever they came out in the local gutter press and got to the point that i was so dumbfounded and got so fucken angry at the totally idiocy of our judicial system that i had to stop reading the court notices (that also includes coroner reports published in te paper).
I came to the conclusion that judges actually live on another planet and don't give a fuck about our society.

based on all that i would imagine that a judge would in actual fact tell the fuckwit that it wasn't their fault that mom cut him off the tit at age 5 and would in actual fact enjoy seeing some poor bastard lose everything they have worked hard to build up and that they sell everything including their soul to pay the said fuckwit some astronomical amount in emotional harm because it wasn't said fuckwits fault that they were doing three times the speed limit and lost control of their vehicle and crashed in to concrete blocks

You can't legally place concrete blocks on the council's berm. By doing so, you are denying the public's access to it. I suspect that the only reason the council hasn't demanded that the blocks be removed, is that the cost of addressing the situation properly, is prohibitive.

Fucks sake mate, it's not like it's a dangerous road. The only way you can crash on that road is if you are driving over 100km/hr when you try and take the mild right-left chicane. If you drive straight ahead you hit the fence. These guys have young kids, and they have had people drive into and through their fence (which isn't a small one) three times in a year. Council has been completely unreasonable. I would be doing the same thing myself.

Fuck these clowns of boy racers.
