    Warning to all kiwi bikers... Stand up be kiwi

    Hi All
    I am new to kiwi biker. I have recently been pulled over by our lovely local cop John Hamilton in Christchurch He pulled me over for the wrong number plate Your driving is fine and you are not speeding (9am new years day on highway 1 outside Kaiapoi) Photo taken of rear of Motorcycle Photo taken of side of Motorcycle. and Im on my way....
    Week later in the mail...
    20 points $50 fine None issue NZTA Number plate
    25 points $50 fine for noise pollution

    Number Plate (It is side mounted raised black lettering white reflected background) This is the requirement of a NZ number plate BUT this is not NZTA Issued so 20 point $50 fine what the hell it has passed WOF for 15 years with this number plate.... ok new rules?????

    Noise pollution... from a photo Yes that right there is NO decibel reading needed by law in NZ It is up to the policeman to determine if he thinks anything is loud. He can pull over anyone he likes Cars Trucks Motorbikes any road vehicle at all. Take a photo and send you a ticket for Noise pollution and you will lose in court. Because its the law....
    The same police man can also make the same judgement on your speed he does not need a radar reading to give you a ticket. It is up to he's discretion and his 20 years experience on wether you were speeding or not..... THIS IS LAW
    HOW CAN THIS BE???????

    You could challenge both if you had evidence to support. A friend of mine many moons ago was charged with speeding, not measured but assumed. Said friend worked out the police officers claim of where he saw him and where he was moments later would've meant that his bike could accelerate far quicker than physically possible. His case was dismissed in court.

    Is BRONZ still a thing?

    Thre CB550 has the old black background and silver letters/numbers and no issues.

    I'd like to know the exact wording wrt to number plates as layed out by NZTA. Maybe those enlightened folk who do this for a living can chime in.

    Looks like you lucked out on the plate. It clarely staits "Only plates issued by the Transport Agency and its agents are legal. Plates purchased anywhere else are unacceptable."

    Can't find anything with respect to noice polution so it's obviously a subjective thing. See if one of the testing srtations has a Db meter and get a reading. If it's not too bad challenge that fine. If you can hear your bike two blocks away hard luck. It's pobably covered in Local Body bylaws or such like.

    REPLY: The number plate is not a road safety issue, therefore the WOF does not care about your plate. Police on the other hand do. if your plate is not of the NZ approved ones it could be that it is one you have made at home. Imagine if people were allowed to make their own plates... I think I have somewhere read that you can only use plates approved by the Ministry. (Personalized Plates manufacturers have the OK to make them)

    REPLY: This is a BS one. He knows you can get out of it, but it will mean that you have to take the bike in to test the dB of the exhaust. As you have a picture (that he did take...) you could prove that the dB test was done with that muffler.

    REPLY: No idea how this is allowed. But yes, I have been on the wrong side of this one too. As I know that I did go faster than the 120K/h he estimated I just put it down to one of those things, counted myself lucky that he did not have a radar and paid.

    OP - your user description says you ride H-D so my confirmation bias suggests to me that your bike has straight pipes ("shotgun pipes") or similar but definitely not the mufflers that the bike came from the factory with. Post a picture to prove otherwise. My bias (based on my observations of how most HD riders I see) also suggests to me that when the Popo first encountered you, it was as you were accelerating hard, out of a corner, from a stoplight, etc., and the noise level was all out of proportion to the surrounding traffic, and the actual rate of acceleration for that matter At that point the Popo well and truly got a hair in his arse and decided to get you for whatever he could. Probably the only reason you didn't get a speeding ticket as well is because you were riding an H-D and not a modern bike.
    it's not a bad thing till you throw a KLR into the mix.

    Fuck you have those idiots down your way as well? Also they tend to lane split in the most dangerous manner expecting every other motorist to get out of their way.

    The noise thing pisses me off. I've never been done for it & am unlikely to ever be done for it BUT we used to have a known measurable noise level now it's "I've decided it's too loud" or "I'm grumpy/don't like you therefore it's too loud"
    That to me is BS, there's no way to protect against it especially on something like a Harley which leave the factory loud (course the answer there is don't ride Harleys)

    I don't think 'Luck' had anything to do with it.

    I don't like the Font of my drivers licence, actually I'm not mad on the picture. Maybe I should make my own version, and maybe wear a Cape for the pictures? Should be ok shouldn't it?

    The devil is in the detail however;

    What are the wording changes for the subjective test?

    The previous wording of the subjective noise test stated that the exhaust noise output:

    “must not be noticeably and significantly louder than the noise output from the vehicle’s original exhaust system at the time of the vehicle’s manufacture”.

    The amended Vehicle Equipment Rule revises the wording so that the exhaust noise output:

    “must be less than, or similar to, the noise output from the vehicle’s original exhaust system at the time of the vehicle’s manufacture”.
