    any solicitors judges out there

    fuck i know this is off topic but can anyone help me!! what is the situation like over here to get a divorce can you get one just like that or do u ave to go through all the ball ache!! of solicitors and all that.. never been through one before so dont know were to start...

    Hi Vicky

    Sorry you have to go through it. In NZ you have to have 2 years of separation before one or other applies for divorce. So no instant fix, I am afraid. But there is no blame here in NZ, just that the marriage was irreconcilable (sp). You have to get a court order for divorce but don't think you have to have a lawyer to do this.

    Hope someone will be more enlightening with this.

    I think you have to get 'separation papers' first... to then prove you have been separated for 2 years....I dont think the cost is that dear either...

    But there will be others on the site who will know more about it...and maybe PM you with the info that you need to know.

    YEAH ANY HELP WUD BE GREAT BUT HOW THE HELL DO U PROVE YOU HAVE BEEN SEPERATED FOR TWO YEARS!!

    just call a citizens advice bureau and they'd be able to give you all the advice you need

    YEAH SURE WAS NICE FOR THE TIME I HAD IT FOR GOING TO TRY AND SAVE FOR A CHEAP RGV250 IN THE MEAN TIME TILL I GET SORTED USED TO HAVE ONE WHEN I WAS 19 WAY BACK IN THE OLD DAYS!!

    or you can prove from the moment you left the house you both shared together...

    go to the family court and talk to the registrar. they will have all the info you need.

    All of this is correct. Many people talk about divorce when what they really mean is separation, matrimonial (relationship) property, child custody (day to day care) etc. The actual divorce (dissolution of marriage) is the last and most minor part of the pain and distress.

    You can apply to the Family Court yourself for a dissolution. In fact both of you can apply using a joint application. The sole grounds for an Order are that you have lived separate and apart for at least 2 years prior to the application.

    The Judge will usually accept your sworn evidence as to separation - after all, the other party has the right to turn up and dispute it and if they don't, the Order for Dissolution will be made.

    You don't need a solicitor for this - call into the nearest District Court. They have piles of photocopied application forms.
