I don't know but for someone to sell cars as a dealer don't they need a licence? Is it possible that you could "inform" the right people so that it is known that this is the sorts of things that the guy does. Sounds as though he has definately breached the fair trading act and I'm wondering if that could some how have some affect on his licence. (If they need one and I'm pretty sure they do, someone please correct me if I'm wrong)

You could always write to Fair Go. Your chance of getting "justice" is probably remote and expensive. However, with a bit of imagination and a cunning plan, you should be able to stop this guy ripping off others. Revenge is a dish best served cold.

Even ring them up at TVNZ to begin with - I have spoken with them before to check out a situation.
I learned (through experience also) my number 1 rule of purchasing vehicles - no money of any amount changes hands until after independant inspection. Vehicle dealers have way too many tricks to play once they have your money.![]()
The deposit was/is fully refundable, the dealer had no right to proceed with repairs at the customers expense without his instruction. To do so the dealer choose to carry the repairs out at his own expense. The contract was conditional on the basis of the 'lemon' report, which the client rejected making the contract reversable. Not on repairs being carried out to the customers satisfaction. Unfortunately with him winding up the business there is very little you can do now.

yeah thats what i understood was the situation. I had a sort of similar situation last September.... I saw a car I liked. test drove it and put a $500 fully refundable holding deposit down on it (made that very clear to the sales manager before I handed it over). I wanted to test drive another one before I made the decision so thats why I didn't purchase it straight away.
I ended up buying the other car and called the sales manager back and told him I did and that I would be in to pick up my $500 after work...... about and hour later the sales manager text me saying that his boss is not at all happy with fully refunding my deposit and that they missed out on selling the vehicle as I had a hold on it. He said he would only give me $200 back.
I rang him back and said "Mate I made my situation fully clear to you and you agreed to the terms I made when I gave you the cash. I know the law on this and I know I am entitled to all of my deposit back. I don't care that you missed out on selling the vehicle, how stupid are your sales guys if they didn't get that potential buyers number and let them know that I don't want it anymore?. I finally ended up up saying "Have my $500 ready by 5pm in $20notes and I will be in to pick it up".
I turned up at 5pm and the money was waiting with the receptionist....sales manager had conveniently gone home early for the day....spineless wanker. I can't believe the dickhead sent me a text instead of calling me...some people just have no fucken balls!.

These cowboys have more than one company set-up so that when they go bust (somehow they know they're going to go under..) they have had most serious assets transferred so that the tax-man (who gets first cut) gets as little as possible. Then everyone else gets the shit that's let if any. It'd pay to watch his place for a bit a check out what he is doing (and he is doing some shiesty deal). Really the only way to get your mioney back is to pay someone to get it for you and that'l cost you as much as what you're owed. Hire the Head Hunters...sounds dodgy, but I had a mate do just that over a similar sized debt and he got his money back quick smart. No threats or anything eiother, just politely asked that "monies were owed to a client."
They take 50% of the debt as payment for services rendered, but the look on his face when some patched up bikers turn up politely asking for the money that he owes you, would be absolutely priceless...ask if you can be there when they do so with a camera!!!![]()

that might have to be an option, my piece of shit car blew the engine in Taupo at the track day and now its almost repaired...... (no body was rushing obviously) and its gonna cost well over a grand to get it back. that 6 hundy would come in handy about now.
oh well screw it, i'm off home for cold Carlsburg and then fit my new chain on my bike and burn the rest of the rubber off my back tyre.......
