    Well, I spoke to them today, stated I want our money back, got the "company policy" crap, informed them that their policy is illegal, asked what the policy document number is and was told the document had no number, it was just "company policy". Informed them that I am now taking them to the Disputes Tribunal and will be contacting Fair Go and other consumer watch-dogs about them. He wrote down in the records that I am taking action further, I said "good day to you" in the tone that implies "choke to death on your own cock" and hung up.

    So now I have to fuck about with the tribunal and, since I have to inconvenience myself with that, I now fully intend to spread that inconvenience where it is richly deserved - by ensuring they get all the negative publicity I can muster.

    Letter to the "Fair Go" Team:

    Kia ora

    We paid $102 to reCONx (0800 RECONX) on Thursday 9 February to get our phone reconnected and were informed that they would get our phone on in a few working days. Late on Friday, however, situations changed and we no longer required the services of reCONx to connect our phone. Their answer phone said "call back during office hours."

    On Monday 13 Feb, my wife phoned reCONx and cancelled the connection and requested a refund. She was informed that refunding was against company policy and that they would keep the money in case we, or members of our family, needed their services in future.

    My wife contacted the Citizens' Advice Bureau and was told, "no, the law says they must return your money" and promptly called reCONx. She spoke with their manager, a woman who identified herself as "Joyce", and just got the "company policy" line repeated ad nauseum until "Joyce" said "I've been talking to you for ten minutes" and hung up.

    I phoned them today after checking the relevant legislation on the internet and spoke with one of the blokes there who said "Company policy, no refunds, we will hold your money." I told him that that was illegal and asked what the policy document number was. I was informed that it is "just company policy it doesn't have a document number."

    I informed him that perhaps the Commerce Commission would be interested in a policy that places them above the law.

    He said "there is currently nothing I can do to refund your money". I then informed him I would have accepted them saying "we can't refund all of your money, we must charge a small cancellation fee" but, since they weren't prepared to give any refund at all, I would be taking them to the Disputes Tribunal for the full sum of $102.

    I do not see it as a "Fair Go" that I have to go through the hassle of a Disputes Tribunal and lose $30 in Tribunal fees just to get the refund that I am entitled to. I cancelled the service well within the 7 days that the Act provides and I feel annoyed that what should be a simple matter has become a mire of their "company policy".

    We got behind on the bill and got disconnected. We're paying back what we owe but in the meantime, I have a pregnant wife who is due to "drop" any day now and we have two toddlers - we needed a phone in order for strayjuliet to be able to call me and the midwife should she go into labour or call for assistance should she or the kids need it.
