I fail to see what this has to do with the Government. I read the first post as "So now some over jealous Maori group is laying claim to owning the right to 'control' ownership all NZ indigenous trees and flora" not "Labour wants to give some over jealous Maori group the right to 'control' ownership of all NZ indigenous trees and flora"
How come everyone's problems are the fault of Labour? Who's really living their lives as victims?
"They say that if I do bungy jumping too much, I might get brian damage."
"I don't even know who Brian is"
I say with regard to the seabed and foreshore, and every other claim, you want it... go do a sit in. Preferably out past the low tide mark!
You want the rights to control the native trees and such, cool but with that goes the responsibility and the right to be held responsible for any cock-ups you make.
If there is any controlling rights to any national asset or interest, such as coal, oil, fisheries, gas, mineral rights etc. Then the rest of us should also have the right to counter-claim for any loss or mis-management of said asset. If the benefits are not going to go equally to all then I say F%$CK off. I bet they wouldnt be quite so keen to claim stuff if they had to be held responsible for the profit making and sharing.

Find a chick who’s just been dumped and comfort her by massaging her shoulders, and soon, she’ll be massaging your prostate.
Says it all really....
Do you realise how many holes there could be if people would just take the time to take the dirt out of them?
It's going before the waitangi tribunal, which has no power, so they can claim whatever they want as the government is just going to ignore the claim.
Seriously though, what the fuck. Is this a joke that went too far? "You should try and claim the trees cuz, haw haw haw."
That word is a corruption of Negro so for our natives it's a misnomer.Originally Posted by sunhuntin

Jeez Wayne! What a lot of reactionary knee-jerk whiteys. I'm a bit Treaty fatigued too but on a global perspective, the reparations system we have in New Zealand for Maori, leads the world. The only other country I can think of which has started to move in the same direction is Canada with the Iniuit.
I have no doubt that the Aussies will eventually, grudgingly, recognise the genocide casually practised against the Aboriginals. The Americans will, albeit centuries too late, similarly try to redress wrongs against American Natives. But the USA has firstly to resolve the legacy of slavery, and while they are trying to deal with black Americans, they have a compounding problem of Hispanic Americans who slightly outnumber the black already.
So we are leaders. And don't forget - the Waitangi Tribunal settlements have been supported by both Labour and National.

So your saying the Maoris somehow used to own the native flora and funa? Do the abbos own the koala and claim royalties on all merchandise with their animals picture on it?
*Warning! Angry rant!*
Thank you Winston! There are knees twitching a plenty at a reflexive level in threads like this, with little deep brain involvement!
There seems to be wee few fundamental misunderstandings in here! I'm no tikanga expert, but the Foreshore and Seabed Act was a kneejerk reaction in and of itself in response to the court of appeal in Attorney-General v Ngati Apa (Under that name in [2003] 3 NZLR 643 if you're interested) which dared suggest that Maori might be entitled to a bit of foreshore and seabed themselves! Good god, what was our highest level domestic appellate court (at the time) thinking! With a full coram of judges as well!
(The crown has underlying radicle title to all our land anyway, I don't see anyone bitching about that??)
The videogame example - I believe that the what was alleged here was more something held dear being used as a cheap, tacky form of iconography in a videogame, than a strict intellectual property issue. Perhaps more at a 'virgin in a condom' type level, although not involving freedom of expression, but mere commercial exploitation of something sacred to Maori. (Moko on a stereotyped Maori warrior in the game from memory - serious as a Moko contains all your whakapapa and history in a graphical form) Not dissimilar to the 'Maori' brand cigarettes sold in Israel a while back...
The common law and statute do not cope well with indigenous intellectual property issues, as there is no way of exercising collective ownership/guardianship.
I could go on, and on, but I wouldn't want any of you to choke on your coffee in outraged indignation...
Hows about actually getting out a few books, and learning something about tikanga? It's bloody interesting! You might just learn something and even be able to form a few *ahem* slightly more intellectually robust rebuttals of Maori claims that may be taken a little more seriously than the ignorant stereotypes portrayed in this thread!
Yes, I know many readers will be 'hating' on me now, but tough! I see a lot of this type of feeble stereotyping on KB. That's fine, I'm all for free expression, but don't kid yourselves into thinking you have any sort of defensible intellectual footholds! Or that you are in the majority, cos, maybe you aren't.
Labour are the democratically elected government. (not that they have anything to do with the treaty settlement process! Pretty sure that the Waitangi Tribunal was constituted under a national government in the 70's)
Get over it, and BTW Labour are nowhere near communist (eh Ixion?), not even hard left, more at a wee bit left of centre!
You'll get your chance at the next election like the rest of us. I'll probably be voting for Labour again unless something better crops up, so![]()
Love, Phurrball/Ross: proudly a Pakeha New Zealander (and no, I don't belong to Labour, cos I don't like everything Labour does!)
(Can we talk about motorcycles now???)
And while we're at it.....what has H.Clark's physical appearance got to do with how she governs the country?!
...she took the KT, and left me the Buell to ride....(Blues Brothers)
