In that case, I'd go with the theory that its a chopper, not a plane. We all know choppers dont like to be banked really hard, something to do with the big rear tyre and the way the pegs scrape.

What's unusual about this is that Manhattan is a no fly zone. It is also surrounded by water providing plenty of opportunity to ditch in the drink. Also, the plane was reportedly flying visually and was banking really hard.

You may fly over that particular area of Manhattan, however the minimum height for that sector is 1500 feet. You should also be issued with a squawk code for that sector, although allegedly this pilot did not have a squawk code.
