Final Update BMW's Insurance Claim

Still trying to rip me off to the bitter end.

Jeez I have had to fight tooth and nail! The bastards tried to rip me off again. Had a discussion about buying my bike back last week, ie 35% of write-off price, less $500 turners fee auction, less $500 that I could have claimed in towage fees but haven't - so told him to sharpen his pencil but the most I would pay was x amount!

Today the bank informed me they would take all the insurance money as it was security for a loan. I had to go out for a cig in the foul wellington weather to cope with that latest bombshell.

Back to insurance co. the price of the bike had gone up $500 - he said he had talked to his boss and that they wouldn't move on that price - it would now go to auction.

I cannot adequately describe what went through my mind at that point - however I wrote to the boss:

"... which is more than reasonable considering the amount of damage. Also I would like you to take into account the amount of time it has taken you to settle this claim and the fact that you were renegging on paying the sum out. Despite my policy clearly stating the facts. I have not had transport for 2 months. I have had to chase you up endlessly and feel I have not been treated well at all. I would like you to take the above into account and settle the sale at $xxx which my bank has offered to pay in full amount and this saves you a lot of time and hassle."

In between waiting for a reply from insurance company, I rang my bank and grovelled saying I need transport etc so they agreed on giving me an amount to buy back the bike.

I actually got a prompt reply from the boss saying they accept my offer of $x for the bike.

All monies go straight to the bank. So I wonder how long that will take for them to deposit the money!!!

Last week I spent a nite in hospital, today the Dr said I could go to hospital voluntarily or she could enforce it - this gets reviewed on Friday. I'm gettin a bus outta town!! lol

So hopefully this is the end of this saga. We live in hope!

So you'll be able to buy your bike back, which is good? Just to refresh my memory what is the damage you'll have to get fixed or are you not fixing it?

Good for you for sticking to your guns, you sound like you really need to take a bit of time to gather yourself together though. This much stress will kill you!

Needs a couple of indicators (already have one lol), new clutch lever, right footpeg bracket needs welding on. I will take the fairings off cos they are scratched to buggery, and I can't remember what else!! And definitely a new helmet!

Having no transport has certainly cut me off from people and also riding was my therapy - if I was stressed or upset I would go riding and come back refreshed - haven't had that luxury and with all that has happened this year (I am told it is no wonder I'm heading for the mental asylum!!)

Dr wants me to take time off work - yeah like I have the sick leave after the accident! Roll on Xmas - have 3 weeks off - I WILL have my bike and I will just tour up the north island!! FREEDOM!!

Wow you have had a tough time with it, a tenacious one you are too. Please look after your health.. You get sick, cant ride, get sicker, no work, can't ride get sick and so on (you know what I mean).

I was once insured with Swan and when my bike was written off they paid out promptly without any hassle what so ever. Just because one person has not had the desired result does not mean the company will "dick" everyone around.

Hit any English websites you need to and source some bits up there. I'm 98% likely to get up there and back by the end of November, and I'm quite happy to transport them bits back into the country for ya.

Because I'm not insured with anyone! I've only ever had insurance while my bikes have been on HP because it's compulsary. All insurance companies will try and wangle their way out of paying, not just Swan. My cousin worked for Tower briefly....she's the biggest bullshit artist this side of the black stump and she couldn't cope with lieing to the clients. Stressed her out something wicked as it was about the time of the Eastern BOP floods.

im glad ive got insurance otherwise i'd be almost back at 6 months ago cash wise (wow thinking about it that way i need to sort out my finances! and stop eating maccas....)
