    Challenging a speeding ticket

    Where's the link showing the stuff you can ask for in order to challenge a speeding ticket?

    I recall there was a link to an external site which had a really good list of stuff... and the steps to go through but there are so many mentions of "ticket" and "Speeding" in here it makes the head spin.

    Anyone?

    It wasn't me officer...a big boy dun it and ran away. I posted my letter on the site about 2 weeks ago. Waiting to hear back from the federali's but I'm not holding my breath for a good result.

    Stuck Caps key or is this Winja?

    I'm looking for the list of things to request.
    Cert of radar calibration, officer's certificate of training on it, etc etc etc.

    What's all the paperwork needed... and I mean aaalllll of it!

    I can't recall all the things you can ask for in "disclosure" but basically its all the evidence the police intend to show the court.

    Calibration Certificates for the Radar
    Officers notes on the day
    Training Records
    User & Factory Manual for the Radar unit
    Fault History of the Radar unit

    A mate recently requested all the above stuff, and was aquitted. The court found the cop had never been trained on the radar, and this was the reason for the aquittal.

    We also found the calibration certificate for the radar relied on a two-point test against a pair of tuning forks. The test was actually 0.6 km out - the police had assumed this was an offset error and that the unit was therefore 0.6 km/hr out over its entire range. (not actually correct, we calculated the potential range of errors as being much larger.)

    Also the tuning forks had never been tested to a standard.

    After the case the cops laughed at our radar calculations saying "all tested by ESR etc etc you would not have won the forks are tuned etc etc", but a pal's a lawyer, and she said we may still have won, as the cops never disclosed ESR testing, so therefore even if it had been done, the court may ignore it.

    In other words, if you ask for disclosure, and the cops tell you the radar was calibrated by method X and you show method X to be crap, the court will not be obliged to listen to methods Y & Z if the cops suddenly remember them in court.

    BUT - I'm not a lawyer, I'm an engineer ! so maybe some of the clever legal people on the site could reveal more.

    Yup - like being pushed off a bluff and radared on the way down... the silly moo. 63 kph FFS...I actually proved on the way home that I was braking too because (I'm told) car driving over the top of that hill will hit 75(ish) at the bottom...

    The silly moo. So anyway I figure I should do the right thing and verify all the paperwork and certification is in order prior to taking any next steps.

    Yep! I used to do that (and more) if I was running late for work...but that was back in the 80's when life was fun and the cops didn't seem to bother with speed.
    You shoulda just flashed your gorgeous body at her, i'm sure she would have let you off!

    Nah, mate! Apparently my thumb has healed reasonably well, but, it is at great risk of further damage if the plaster is removed... y'know - sticks out like a sore thumb, sort of!
    But they gave me this really trendy blue boot,absolute fashion statement, with velcro and everything!! So I am allowed to walk now, should make life a little easier.
