Been trying to find the legislation on driver responsibility. The bit I am trying to find has to do with vehicle safety. So you are ordered by your boss to take a truck load of tomatoes out to the Black Stump and you suspect that the bonnet is faulty. Trucks got a COF but the bonnet clip just is not right but the boss got t ton of cash on this order and orders you to carry on. So where are you legal rights when in doubt about your safty and other road users safety. Got a bit of a bitch goin on with this at work.

I always kept an close eye on the problem till it was fixed..... or for eg: if it was out of a COF then Id take it to get one myself. And I always made sure that the boss knew of the situation.

If it's not in the Traffic Legislation, then it's almost certainly covered by Health & Safety.

Or you could call your local cop shop & ask to speak to a CVIU cop about it.

I'm glad the cop who was to test me for my HT licence decided I wasn't responsible when he checked the truck over and found the RUC certificate was expired by 5000km....
Perhaps he was lenient (sent me away with a warning for my boss) because it was a gubmint vehicle.
Next time I turned up to borrow the truck for the test, it had no brakes.
The ornery workshop dude said I could use it if I helped him bleed the brakes first. Luckily I was early so I had time to fit in this last-minute maintenance...

At the end of the day it's the drivers responsiblity.
If something goes wrong your boss will cop it as well but you will be first in line.Personaly I'd find a new job.If your boss is going to knowingly put you and the public at risk,he doesn't deserve a top of the line driver like you.

Yep to what Jack says - driver takes the blame,the ultimate responsability rests with the driver,but you can point the finger at the boss.Bit like roadworks signs eh.

Be careful about comparing a CoF to a Wof,they are not quite the same - things that would be a downright fail for a WoF are not an issue for a CoF,yet petty little things of no consequence are failed.When I was looking after a fleet of rental cars I would have to do a complete repaint if a boot lid was faded,yet truck cabs can be in a hell of a state no worries.

Its the drivers responsibilty to ensure the vehicle they are driving is safe and has current wof / cof / reg etc. Its you arse in a sling if you get busted or kill someone. The boss will be in the firing line too, (OSH) but I wouldn't put myself in that position in the first place because it would be me that gets the convictions if someone died.

My advice would be to stand your ground and don't drive it if you believe it is unsafe, if the wanker sacks you over that then you will no doubt clean the prick out in the employment court for unfair dismissal.
