    I was lucky and allways had good tenants.Im sure there was a safegard of sorts, to get rid of bad tenants.I think it went like if you needed the property for yourself or family, you could just give them 6 weeks notice.

    In a tenancy court this would not make any differance because that is still illeagal. Even if you have signed a tenancy agreement saying that the law is 90 day

    Cut your losses. register your debt with WINZ and persue it with both them and the tenants.

    Then have a family member move in - even for 3 days. That pulls back the eviction period to 42 days... which is better than the statutory 90.

    If they're dodgy tenants then wtach the place like a hawk (good neighbours)? Ask the neighbours to ring you if they see anything suspicious. Don't let anything slide.

    And good luck - wish there was more I could do.

    close but no - there are 2 exceptions I know of.

    1) Have a family member move in
    2) Have a signed sale and purchase agreement that is conditional on the tenants moving out.

    Both of these cut it back to 42 days.

    The other things that can be done to incent the tenants to move out - put the rent up or something that makes THEM hand in notice - 21 days...!

    of course it can be sooner by mutual consent. Hire a ghost ought to do it... or smash a few of your own windows and give them the shits...

    UPDATE:

    After finding them the night of the mediation meeting, they promised to pay this weeks rent and were going to WINZ and wanted a letter from us, which we gave...

    No rent paid... nothing heard...

    Then in the mail today, the Tenancy Hearing won't be happening until the 16th July!!!!!!

    Another three weeks rent to be missed out on for us... Fucken useless.....

    Make it look like one of the locals - is this house in Waitara - if so - I can probably give you a couple of names..... Clears out the tenants and the insurance pays for a rebuild!

    Pain in the arse uh... I had furniture and belongings that they left behind... of nil value of course. and I had to wait for a court order to make them mine to dump them... I guess I did not "have to" but I thought I would at least follow the shite procedures so I cant get done against... ya just never know what turn they might make on ya.

    Go to the 2buck shop and buy a stress ball!!!!!!

    Mow the lawn each week, and say that you're going to do it when you've got new tenants.
    Why? Because it means you know that the house is still standing.Not only that but if there's a problem with the house, they have no reason not to tell you then and there. (Otherwise you'll have the fun of finding out that something has been flooding for six months and never been told...)

    No excuses, ever. If they miss one week they will miss more.

    If they ring you first to say there's a problem, and that they're going to have to miss a week's rent but they will pay you back next week. That's probably okay, as someone who rings you cares. But if you find out they've missed, kick them out.

    Have fun trying to get the rent out of them. After Dad set Baycorp on one his tenants after they did a runner it still took something like 5 years to get the money out of them.

    Give them their notice now, because you don't want them any more so they are gone no matter the outcome of the tenancy tribunal. The other advice of getting a rellie to move in is good. A good big rent increase is probably nt the best at present before the tribunal hearing, but before it got to this stage, it would have been a good first move.
    THis is why I prefer commercial property...

    i had a student flat in dunedin a few years ago, good return but lots of damage inc front fence ripped down and burnt, smashed windows (result of playing cricket in house) almost all crockery that was supplied smashed, hundreds of bottles smashed in the back yard, shed in back section burnt down(end of year party) but we did get the bond back around $300 which didnt go anywhere towards cleaning up the place. These people are now doctors and lawyers but at the time were "high spirited" students just enjoying themselves at our expense. I always laugh at people saying that the student flats are hovels but these cunts can turn a new house into a complete wreck in 1 year, i sold that and at the moment have a old place that my 82 yo mother in law is living in for free and when she dies its going to be sold i cant be bothered with the hassle and problems with tennants

    As a landlord presumably you're responsible for the upkeep of the water and electricity supply e.t.c..I reckon a safety check of the wiring must be well overdue,maybe the leccy might find something seriously wrong.Obviously for safety's sake you'll need to turn the power off,trouble is it might be something really obscure that's the problem and your mate the Sparky might have to order it from who knows where.Obviously you'd have his say so in case you were slanderously accused of trying to drive these good people out and maybe proof that he'd told you he was going to order the parts just in case they go to whoever in NZ deals with this sort of thing.If your so-called buddy then stops answering his phone or has a long wait for the relevent fault is it your problem?Maybe he'd find such a mess he'd have to condemn the whole thing and you might just have to wait for him to completely re-wire the place before it was safe to put the power on again,and how long can people like that survive without the tv let alone light and a method of cooking?Alternatively there's the water-leak a plumber buddy might just have to create while you've done the good landlord thing and got him to check the plumbing,off goes the water and your place might not smell too good when you get it back but how long could you stand to live in a place with no water? You could tell them that as they havn't paid any rent you can't afford to pay for the work but that's probably too obvious.
    We have tenancy laws here as well but in reality the delays work both ways,unless there's a criminal act involved the tenants have to go the slow legal route as well and with no water or electricity,not going to last long are they? Say they call the Police and report you,I assume from this post you're a Cop,they'll get all of 2 minutes worth of "Sorry but the property's not safe and he's trying to fix it",best thing you can do right at the start is be reasonable,apologetic and friendly,assure them you're trying the best you can to sort their problem,which of course you are,just not while they're still there.
    In the UK apart from basic accomodation or the "Migrant worker sardines" kind of thing it's common to ask for large deposits,references and sometimes to have 3 month rolling contracts,prices a lot of people out of the market sadly but that's the bums spoiling it for everybody else.If you're tenants damage your place you take it out of their deposit(make sure you inventory the place first and get them to sign regarding what's there and in what condition),if they clear off you keep their deposit,usually about a month's rent.
    If you want to play dirty if they're on benefits run off a few business cards advertising a taxi service,or some other kind of business,get them left around town,then send one anonymously to the authorities reporting them for fraud with the Taxi thing they've got to explain that new car.
    As Jeremy says they probably don't want to live there,they just want to blag as much free accommodation as they can before they move on and do the same thing elsewhere,if that's the case a bit of discomfort could well be enough to nudge them out.

    Friend has a tandem trailer and they loaded up all the shit his past tenants left behind, dozens of bags of rubbish included, knew where they moved to and took it around to their place and dumped it on thier doorstep - shitty nappies and all...

    There lies the problem... gotta give them 90 days to leave, (42 if it is going to be occupied by a family member) or go thru the Tenancy bullshit... come the 16th July, they are out... much shorter than the 90 days, but still no real protection for the owner (me) as they can still stay, without paying rent, until the TT orders them out...!!

    Same as just above Geoff... No worrie about the TT coz they will order termination of tenancy and possession back to me. I will DEMAND that they be gone in 24 hours!!! have raised rent already, but as they aren't paying now, it aint gonna fix anything...
