    While the mortgage is being paid consistantly I like to think WE own our property until such a time we can't pay the mortgage (for whatever reason ) - maybe i'm kidding myself lol!

    Our Mortgage was structured the same as yours where we took up the slack,

    Because the lawns are turning into hay and the gardens are overgrown, I dropped in to see them last night to remind them that they need sorting before they go, and that the rubbish in the garage has to go too....

    They looked out and saw the patrol car and came to the door fairly quick for a change... Although they have been friendly throughout, this time he was even more so, for some reason........

    Very apologetic and promising to pay, saying they will sort the lawns and other stuff before they go, said, "We are going to pay you..." promising to pay "when their money comes in" still, blah blah...

    Even shook my hand for the first time at the end of it all...

    I think the house is now very safe.. he now knows he can run but can not hide... it all looks good at this moment in time... We will have to see!!!

    bugger me .i lived in ozzy for some years and my mate had the same problem.he got me to go around posing as a door to door sale man ,selling dvds .when they open the door i grabed the women and chucked her out on the street the locking me inside and her out my mate called the police and she was gone .but think its differnt here ,squatters rights i mean.a fkn good punch in the head never fails or just string one of there animals up ha ha

    Hmmm I think if we do it again and we have bad tenants I might get a policemans/womens uniform to wear when I visit to collect the rent..... (joke)

    Holy shit dude. It gets to the point where it doesn't matter how much they plead ignorance, you know otherwise. What the hell did they expect?! They've never bothered to actually pay their rent and then get pissy when they're served an eviction notice? Honestly, noone is that stupid, not even them. Good move to show up dressed in your best blue suit too, that'll light a fire under their bums because they now realise who they're dealing with.

    Patrick,given the response to your uniform,might just be an idea to wear it when interviewing future potential tenants,"sorry,just got of duty",if they know the score before they move in,or decide not to after all,might just save you a lot of hassle afterwards.

    Update:

    Went around Saturday to take possession, only to find them still moving out, not there, but stuff in the house still.

    The lawns and gardens still not done... but...

    The back door, one of those two thirds glass pane on top and one third glass pane on the bottom thingies, the bigger top one had been smashed out and instead of getting the glass replaced, they screwed a wooden door, yes a whole door!!! to the outside of the back door to block the hole where the galss once was. So there will now also be screw holes in the back door as well now, but... we also find three holes in the walls, two possibly by moving furniture, and one is behind a door and looks like a punch. Things have been cellotaped to the wall paper and when these have been taken down, they have ripped the outer layers of the wallpaper, but as we were wanting to redo the paper and repaint anyway,... (The curtains are a shambles and all the hems have fallen away, but that is easily fixed...) Otherwise, it is not too bad.... sorta.....

    Contact them and you guessed it... all the stories, can't get a trailer, all promises to mow the lawns, do the gardens, fix the holes and the glass door, blah blah...

    Then they ask if they can store the last of their stuff in the garage until they can get a trailer... which we reluctantly agree to only if they get onto fixing things up pronto but Tuesday is out day, otherwise they will have to pay extra days.

    The best part is that all this saga has been on text, recorded and able to be used in Tenancy matters...

    A fine weekend weather wise, make contact as nothing changed, promises about getting in and sorting on Monday... which was also a nice fine day... but, no........

    Tuesday comes and goes, nothing changed...another sunny day, not answering texts or calls.

    Wednesday morning I visit the address "while patrolling" and locate them pulling out of a drive 4 doors up?? All promises repeated and they say that they will pay for extra days etc (Yeah right... they didn't pay any rent whatsoever for how many weeks now???), still can't get a trailer until Friday as all garages are booked or they are broken, whatever... promises to get a contractor in to mow lawns...

    Notice during patrols for rest of day, EVERY garage I passed in town had trailers for hire, all sitting idle...

    Promises again to sort damage and have lawns etc done, but having trouble getting a mower now...

    Ask for keys to be left behind so I can pick them up Thursday, as all their remaining stuff has been moved into the garage...

    Contact him Thursday morning and ask what is being done. Says he "is going there today (Thursday) to fix the holes and "The Glass Man" is coming today (Thurs) or Friday to fix the door, the keys will be left inside on the kitchen bench."

    Make some off duty civvie enquiries and find that they moved into a caravan park in New Plymouth and are there for a month so documents can be served in the VERY near future... Also ring The Glass Man... never heard of the tenant, are booked solidly into next week and no job ordered for the rental...

    Discuss my saga with the courts, and because the car has finance owing, they won't seize it

    But the fines enforcement girl who recognises me, says "With a Distress Warrant, we can have it clamped instead..." I think I am in love....

    Go to rental to get keys later that day and as expected and as you probably guessed it... no keys, no repairs...

    Knowing they are coming to pick up thier stuff on Friday, I let it slide as there is nothing I can do. I am told by the Tenancy Tribunal that I am responsible for the safety of thier stuff in the garage... WTF???????????????
    I point out that they are supposed to be gone, they have put the stuff in there themselves... "You're responsible..." they say. Get FUCKED!!!!!!!

    To top it off, because they haven't vacated fully, I need to apply to the Tenancy Tribunal, AGAIN, for a fee of $20, AGAIN, at my expense, AGAIN... so I can:

    - obtain possession of their remaining shit so I can ditch it, (tip fees - my expense!!!)
    - for them to pay for the extra days,
    - to get an order made about the damage and cost of repairs for them to pay (and the lawns too...).

    Meanwhile, we have people wanting to see the place but can't show them because of the state of it...

    Am about to go around shortly now to see if the holes and door have been fixed, the keys have been left behind, and their shit is out of the garage once and for all... its been raining so I know the lawns and gardens wont have been sorted... but I am not holding my breath.....

    Monday coming will be a fun day. I will obtain the distress warrant and have their car clamped. That'll fuck em... for starters... Being the calm cruisy sort as I am, I am about to get a little peeved, then irate.... then angry, just before I get full blown "YOU FUCKED ME OFF BIG TIME LOSER..." Tis the calm... just before the storm... My avitar is rather pissy in comparison to what is coming their way...

    So which is worse, Dealing with arseholes constantly while in uniform, or dealing with your useless tenants?
    Either way I think you have alot more self control/discipline than I could muster.

    Obvious that the uniform only momentarily checked their step, these people just don't care and the government protects them.

    Tough luck there Patrick, I say cut your losses and invest the money into commercial property, there are less hassles like you have been going through!

    You are not alone, I have been enquiring and this sort of thing is "not" uncommon! Hope things get better, cheers, John.

    I wish... They were my tenants, in my property, who have been booted out for damn good reason, but left their stuff in my garage, which still makes it my problem... apparently.... according to Tenancy Board...... I am "supposed" to ensure it is safe and secure....... or else they can come at me for their "loss..." What a crock of..........
