You also have a redress under the Consumer Guarantees Act. There is a general expectation when you buy the bike that it will last at least 50,000km before needing some replacement parts. But at no time as you say, would you expect a total mechanical failure within 100,000km at the very least.

The Act basically says that you are right. "Manufacturer's Warranties" have really been superseded by the Act where the test of your reasonable expectations when you made the purchase becomes the defining factor.

That's not a card to play lightly though. Wait until all othe avenues have been exhausted

This is an interesting one. The distributer mught be tempted to argue that the customer should not reasonably expect the bike to last longer than the warranty because of the coutnry of manufacturer is not "generally accepted" as being a location that make quality prouct, unlike say Japan. However, they would be shooting themselves in the foot.

Distributers of Italian and British bikes could also make the same argument.

TSS has confirmed there is something wrong with the engine... I think they are going to start pulling it apart tomorrow and find out what exactly the problem is. Then they will contact hyosung and try to get it fixed under warrenty, seeing as how the engine should last a little longer than it has.
Hopefully Hyosung will decide to be good buggers and fix it under warrenty.
