    Sorry about your troubles gtr.

    My cheap advice is that if i find myself in similar situation now, I just chuck a U turn, ride up the footpath - whatever - ignore the losers, exit the situation and head to where I'm going another way.

    I know that no matter what happens that makes me the winner. Life ain't worth the pain of even acknowledging the fucktards.

    That's pretty hairy!

    Anyway, I am sure that anyone - especially a reasonable person, e.g. a judge - would be understanding of how scary it would be being threatened with a vehicle and having abuse yelled at you. As such, if you in your state of near-panic react more violently than what is reasonable, you might be able to defend your assault charge.

    Good luck with it - I hope you managed to break a few things on the idiot so he will remember how much riding gloves hurt for a while.

    yeah i agree , but i tryed to gap it but he persisted in his actions.even when i stop he was still going at me and grab my shoulder.
    thats when he got the knock.
    ive got a witness to the whole thing,told the cop in my statement that it was selfdefence,two or three times
    cop was pretty good over all but he said because i didnt try and calm the situation down before i swung at him ,just went at it he had to charge me with assault.....
    was gunna plead guilty but the more i think about it the more i want to fight it
    will talk with the wife and take it from there.

    but get our self a good lawyer... If he grabbed you first "assaulted you" you only did what was needed to "defend" your self in the circumstances that you beleived them to be, IE verbal abuse, vehicular assault, physical assault......

    Write a few apologetic letters to cops/court etc. Anything to get the charge reduced to something less severe.
    Amazing what a bit of remorse can achieve with the "beak", (judge).

    Fuck the apologetic letter fella, stand up for your rights. About time someone took a stand for common sense. The judge should throw the case out and tell the police prosecutor to fuck off and stop wasting court time........ easy for me to say from the keyboard I know, but this fecks me of no end, so someone got aggro, someone got a punch in the head for their efforts, might make a few people think more before they want to nut off at a motorcyclist..................

    Yup thats as I understand it from my old martial arts instructor - under NZ law - if you believe you are under threat and about to be attacked you are within your rights defend yourself within reason. Get a decent lawyer before making a statement, they will pay for themselves in the long run.

    Fuck that makes me so angry to read. That's so unfair. Some fucken psycho comes and starts fully threatening you, all you do is try and counter the threat and you get in trouble as well. Where is the justice in that??

    What the fuck kind of a country do we live in where people like that get treated better than people who never set out to hurt anyone. I don't get their attitudes. Who the fuck makes them think they can just start hurling abuse at people for next to nothing, even though they are wrong, and yet they still try and defend their worthless, rotten selves. It's fucking bullshit, man.

    We need tougher laws in this country against people like that but of course it won't happen will it. The rest of us have to live in fear that we'll piss someone off and this will happen, especially when we're on a bike as this makes us so much more vulnerable. What would you do if he rammed you off the road?!? You could be dead!! And that fucker would probably get off on a nice cushy sentence somehow, so some other poor innocent cant be hurt.

    Admittedly I'm in kind of a shit mood right now, but man I can't help but get so angry when shit like this happens.

    I'm real sorry this has happened to you, man. I dunno what I would have done if it was me. It's a very frightening thought because I wouldn't want to be humiliated by running away but wouldn't want to get in trouble for fighting back. Why do fucking arseholes like that have to make their own problems everyone elses, then we all have to suffer.

    Let us know how it turns out.

    Mate if you grab a cops shoulder or any other part of him then your done for assulting a police officer (if he/she deems it so) so am guessing that by grabbing you then the guy has commited the assault and as you say the rest is self defence,if me i wouldnt lie down,may cost but definately worth getting a lawyer and defending it.
