    assault charge

    just talkn to chris hocquard,great guy,does the free legal bit every thursday on bfm
    were going to enter no plea,get a stand down for two weeks or so and wait for the rogers guy,john matthews,to get charged
    then go from there
    chris said cops would have charged me with "assault",so as i was in the system and the courts can sort out the rest.......

    cops got all details ,the cop that took me to the cop shop said good on me as well ......

    Could be a routine matter of charging the person who strikes the first blow with assault - any resident coppers who can comment on this?

    From the rather aggresive/borderline psycopathic behaviour blood and urine tests might be in order to establish whether drugs could be involved.

    If you are referring to legal aid, you need to be of the ethnicity of the offender and/or without a job. Cultivating, armed thuggery or breaking and entering are non work related activities. Our man is on a hiding to nothing.

    It's called preemptive strike. I can't remember the case law, but I know a few cops that have got off being charged with assault by using it. If your options to retreat/escape are limited, and the situation was one that you may have been able to avoid in the first place, then defence via pre-emptive strike may be your best course of action.

    I have to agree with all of the above because they are all how I would feel in the same situation, depending on my mood.
    Emotionally I would wish bad things to happen to the bastard.
    But ultimately Big Dave is on the money.

    It's hard to do, laugh and ride away, even harder if you can handle yourself, but where gtr is turns out to be one of the favourable outcomes. (not on your case gtr - respec - annoyed you are charged)

    I've scouted every path, laneway, cycleway and exit route in greater Auckland that I can find. Why I have an urban ADV bike and you never know who you might need to duck. :-)
