    Car troubles

    Sorry for posting in a bike forum BUT
    What would you do in this situation?
    You live in Windy Wellington l
    A friend of yours is having some fairly major work done on their sports car by a specialist panebeater in Rotorua . You offer them the use of your sports car to drive whilst theirs is being sorted and for a period after this in case their car gives problems. You ask to be kept updated on progress with their car and how things are going with yours.
    The car duely leaves with all concerned happy.
    Your friend isn’t happy with your choice of tyres so fits their own personal choice.
    Months go by You hear nothing from said friend. From a third party you hear that some minor damage has been done to your car.
    Your friend uses parts from their car to repair the damage they did to your car. In order to keep yours on the road.
    Still you hear nothing from your friend.
    A few months go by and your friend crashes your car doing a reasonable amount of damage. Not major but none the less reasonable amount.
    They then leave the car with the panelbeater in Rotorua who is working on their car. They announce to the panelbeater that they don’t want to use the car anymore. The parts borrowed from their car are quickly removed from yours as are their tyres. Your car sits on blocks as they have lost your tyres.they then walk out. >>
    A few weeks later said friend picked up their (by then completed) car and drive out.
    3 months goes by and nothing has been done to fix your car .The friend hasn’t made a phone call to the panelbeater or to you to organize repairs.
    Your car is still sitting on blocks with no wheels or tyres.
    You call the panelbeater to organize work on another part of your car whilst the repairs and replacements are being sorted –This work happens in a timely order.
    You make contact with said friend to ensure repairs are progressing and that your car would be returned to you in a reasonable time. The freind states “Oh I thought you and the panebeater had sorted it out” You make it quite clear that this is definitely NOT the case . You wait and still no contact and no repairs
    Besides the fact clearly you have been a prize sucker and deserve all you got how would you sort this out?

    Register some sort of lien on their car, or have it 'repossessed' until yours is returned to you in the condition it was when you first lent it, and at no cost to you.
    Do you realise how many holes there could be if people would just take the time to take the dirt out of them?

    I think he needs a Financial Darwin Award.

    Mind you I did a similar thing last year - a friend of my younger daughter needed a car while she saved to get her's repaired.And as she had loaned my daughter a car in the same situation previously,she asked if I could help....so I gave her one of my cars.She lives in Clendon,duh - one day all the cars in the street have their rear screens smashed,so now she has 2 cars to fix.Six months later nothing has been done - we organise a screen replacement,billed to her,and she supplies a new battery.My problem solved....and the girl is in even more financial trouble.By the way she is dying from cancer.....SO???

    To my knowledge, your only possible recorse is to go through small claims court, unless we're talking more than five grand, at which point it becomes a differnent type of legal battle.

    What would I do?... Probably better discussed via PM.

    Your a soft Coont FROSTY...ring your freind and give them two weeks to sort it.
    Tell them your Lawyer and the N.Z Police are on stand by.

    find the car and take his wheels (obviously they fit your car).

    Then inflict the same pannel damamge done to his car as he done to yours.

    Simple.

    I gather their car is of the same model...so simply go and pick up their car and remove required parts and "invoice" them for the time/costs incurred during said process.
    Has always worked for me anyway

    Difficult one...I would see a Lawyer for an hour so it does not cost you too much and find out your options...(I thought the DT limit was $7,500).

    No point doing same to him because it will just turn nasty and you need to keep to the rules to avoid finger pointing.

    Certainly worth going down the DT way. Will not cost much and you having nothing to loose. If he does not attend hearing and Referee awards in your favour then you can go for an attachment of earnings as things progress and this is gonna cause him more grief.
