    I'm anal about people touching my stuff.. but clothes and towels etc are fine. just as long as it's not personal stuff or my books without my permission.. in saying that, she's one bloody weird chick... and you're well within your rights to be pissed off. stick it to the girl and if she doesn't pick up her act, then kick her out!!

    Yes, I agree with the sentiment that if this was a student flat MGST would be an anal and intolerant flatmate. However, this is a slightly different situation.
    He's renting out a room in HIS OWN HOUSE - not sharing the cheapest accomodation available with likeminded fellows. I think it is entirely reasonable to have higher expectations than that!

    On the other hand, I agree that he should have picked up on his gut feeling from square one and never let his current tenant move in... Your gut feeling is almost always right - and it's usually worth being wrong whenever it isn't...

    I was going to say the same thing. And the fact that there was no lease is immaterial. Money is being paid for a room. It's called an implied contract, and that kind of contract is often tested and found to be valid in court in tenancy disputes.

    If the hairy Brazilan wanted to push her rights in the tenancy tribunal or courts she might have a case. Of course, she won't, and good riddance to her, but she could if she wanted.

    Not necessarily. Similar situation happened in Aucks to a mate. No tennancy agreement was signed, and nothing was verbally agreed upon except for the amount of the money per week and expenses. The (renter),does not have the right to refuse any resonable request from the person who owns the property. If the home owner requests the person to leave, for whatever reason then they can stipulate a time frame that they wish them to be gone by, and then if no compliance, the other person can then be trespassed. In this situation the home owner, has access to any and all areas of their property at any time, for whatever reason.

    If upon first moving in, or in the period immediately following the verbal acceptance, and condidtions are verbally imposed, such as splitting costs for maintenance, or a standard of cleanliness is requested, and the person then does not comply. Then it can become a matter for civil dispute...Not a tenancy tribunal, they do not handle disputes between flatmates (or between shared accomadaters)...

    You are only protected by the tenancy laws if you have signed an agreement. Anything else is a matter for civil dispute
