I had organised to buy a car today, decided to do a quick VIR check, turned out that the owner used it for security with a finance company. The person selling it on bahalf was un-aware of this, and If i had purchased it, the finance company would of had the power to re-posess it..

actually most of the chemicals that were made at the site are insoulable in water, so the water supply is good, and its piped in from else-where anyway.
The site was across the road from my house and down a bit, the cleaning plant is about 50m away. It used to make alot of noise but has closed for holadays (i think)

If ya like the car dont sweat the security thing.
Get a settlement figure and ya pay the finance co out and give the seller the balance.
Also keep in mind that the security could me moved to another vehicle or possibly goods
Unless its a definite shifty deal I wouldn't be too worried.
Also Finance companies are notorious for not removing securities on vehicles.
It may pay to give them a call explain the situation and see if its their error.

The PPSA makes it pretty difficult to screw things up these days. If there is an interest registered, it is most likely valid and could exceed the value of the car.

*Nobody* is stupid enough to fail to realise that securites are registered against vehicles, or that a new owner can still be hit with the repo if the original finance is defaulted on.

In this instance I'd say there's a 95% chance the seller is being dodgy. Run a mile. If they'll do that, who knows what else they're trying to hide?

yes, i know... not my first choise for a bike, but its a comprimise (sp?), the only thing my father and I decided would be suitable, things with the styling of a FXR 150 or similar, are apparently un-suitable... at least its a bike.

Yeah security & finance are evil things. It can easily exceed the value of the car if the guy is ticked up to the max (let’s say he owes 20k) & he has a couple of loans even if he paid out the amount for the car but defaulted on the rest of the loan they would still come after the car.

One would need an assurance from the finance company that this would release the security on the car.

I am in no way an expert but assume a finance company doesn’t care who they extract the money from.

As an example, let’s say you buy a house with your partner. Your partner & his/her former have some financial messiness (let’s say they have a loan or two) & you can basically end up liable for their ex’s debt, they can even crank up more debt! You can sell the house but unless all the debt is squared up then you still are liable the money.

It is real ugly & not many people realise how it can be so unfair! (I saw this example on Fair Go).

Re the GN: Try to save a tickle more & get a Sparda model VT or a CD250 if you can find one. Life will be a lot happier.
