Bit of a loophole in that actually... "maximum design speed of 50 km/h or under". Which doesn't mean that it can't exceed that speed once it's been tickled up...
If it wasn't for a concise set of rules, we might have to resort to common sense!

accordingto the road code if it can exed 55 it needs a warrent and the rider needs a class 6 licence
Or you just need to be able to slow down fast when you see a piggy

The 'Road Code' is a mere interpretation of the regulations and cannot be used as a defence (and by logical extension, for prosecution) - I recall someone saying there is a disclaimer in there somewhere to that effect.

Traffic Regulations 1976 (SR 1976/227) (as at 01 October 2008)
Moped means a motor vehicle running on 2 or 3 wheels that is fitted with a motor having a power output not exceeding 2 kilowatts and is designed to be ridden at a speed not exceeding 50 kilometres per hour under normal conditions of use
    (my emphasis)
If it wasn't for a concise set of rules, we might have to resort to common sense!

The proposed new traffic regulations will plug that loophole:

Various changes have been proposed to the Land Tansport (Road User) Rule 2004, see here:
In addition to compulsory headlight use, there's this one:

By law, mopeds are not supposed to be able to exceed 50 km/h. But it's not illegal to actually exceed 50 km/h, provided you don't exceed the general speed limit for the road in question. It is proposed to eliminate this anomaly.

    Submissions close 16 October.
